حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، عَنْ عَمْرِو بْنِ قَيْسٍ، عَنْ أَبِي إِسْحَاقَ، عَنْ صِلَةَ بْنِ زُفَرَ، قَالَ كُنَّا عِنْدَ عَمَّارٍ فِي الْيَوْمِ الَّذِي يُشَكُّ فِيهِ فَأُتِيَ بِشَاةٍ فَتَنَحَّى بَعْضُ الْقَوْمِ فَقَالَ عَمَّارٌ

مَنْ صَامَ هَذَا الْيَوْمَ فَقَدْ عَصَى أَبَا الْقَاسِمِ ـ صلى الله عليه وسلم ـ ‏.‏

It was narrated that Silah bin Zufar said:

“We were with ‘Ammar on the day concerning which there was some doubt. A (roasted) sheep was brought and some of the people moved away. ‘Ammar said: ‘Whoever is fasting on this day has disobeyed Abu Qasim (ﷺ).’”

Al-Sindi — Hashiyat al-Sindi on Sunan Ibn Majah

قَوْله ( يَشُكّ فِيهِ ) أَيْ فِي أَنَّهُ مِنْ رَمَضَان أَوْ مِنْ شَعْبَان بِأَنْ يَتَحَدَّث النَّاس بِرُؤْيَةِ الْهِلَال فِيهِ بِلَا ثَبْت ( بِشَاةٍ ) أَيّ مَصْلِيَّة كَمَا فِي رِوَايَة التِّرْمِذِيّ قَوْله ( فَتَنَحَّى بَعْض الْقَوْم ) أَيْ اِحْتَرَزَ عَنْ أَكْله وَقَالَ اِعْتِذَارًا عَنِّي إِنِّي صَائِم كَمَا فِي رِوَايَة التِّرْمِذِيّ وَحَمَلَ الْحَدِيث عُلَمَاؤُنَا عَلَى أَنْ يَصُوم بِنِيَّةِ رَمَضَان شَكًّا أَوْ جَزْمًا وَأَمَّا إِذَا جَزَمَ بِأَنَّهُ نَفْل فَلَا كَرَاهَة وَبَعْضهمْ قَالَ بِالْكَرَاهَةِ مُطْلَقًا وَالْحُكْم بِأَنَّهُ عَصَى تَغْلِيظ عَلَى تَقْدِير الْقَوْل بِالْكَرَاهَةِ.…

AbuIshaq reported on the authority of Silah: We were with Ammar on the day when the appearance of the moon was doubtful. (The meat of) goat was brought to him. Some people kept aloof from (eating) it. Ammar said: He who keeps fast on this day disobeys AbulQasim (i.e. the Prophet) (ﷺ).

مَنْ صَامَ هَذَا الْيَوْمَ فَقَدْ عَصَى أَبَا الْقَاسِمِ صلى الله عليه وسلم ‏.‏
