أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ الأَشَجُّ، عَنْ أَبِي خَالِدٍ، عَنْ عَمْرِو بْنِ قَيْسٍ، عَنْ أَبِي إِسْحَاقَ، عَنْ صِلَةَ، قَالَ كُنَّا عِنْدَ عَمَّارٍ فَأُتِيَ بِشَاةٍ مَصْلِيَّةٍ فَقَالَ كُلُوا ‏.‏ فَتَنَحَّى بَعْضُ الْقَوْمِ قَالَ إِنِّي صَائِمٌ ‏.‏ فَقَالَ عَمَّارٌ

مَنْ صَامَ الْيَوْمَ الَّذِي يُشَكُّ فِيهِ فَقَدْ عَصَى أَبَا الْقَاسِمِ صلى الله عليه وسلم ‏.‏

It was narrated that Silah said:

"We were with 'Ammar and a roast sheep was brought and he said: 'Eat.' One of the people turned away and said: 'I am fasting 'Ammar said: Whoever fasts on the day concerning which there is doubt, has disobeyed Abu Al-Qasim."' '

Al-Sindi — Hashiyat al-Sindi on Sunan al-Nasa'i

قَوْله ( فَتَنَحَّى ) أَيْ اِحْتَرَزَ عَنْ أَكْلِهِ وَقَالَ اِعْتِذَارًا عَنْ ذَلِكَ إِنِّي صَائِمٌ ( الَّذِي يُشَكُّ فِيهِ ) أَيْ فِي أَنَّهُ مِنْ رَمَضَان أَوْ مِنْ شَعْبَان بِأَنْ يَتَحَدَّث النَّاس بِرُؤْيَةِ الْهِلَال فِيهِ بِلَا ثَبْتٍ وَحَمَلَ عُلَمَاءُ الْحَدِيثَ عَلَى أَنْ يَصُومَ بِنِيَّةِ رَمَضَانَ شَكًّا أَوْ جَزْمًا وَأَمَّا إِذَا جَزَمَ بِأَنَّهُ نَفْلٌ فَلَا كَرَاهَةَ وَقَالَ بَعْضُهُمْ بِالْكَرَاهَةِ مُطْلَقًا وَالْحُكْمُ بِأَنَّهُ عَصَى تَغْلِيظٌ عَلَى تَقْدِيرِ الْقَوْلِ بِالْكَرَاهَةِ وَاَللَّه تَعَالَى أَعْلَمُ.…

AbuIshaq reported on the authority of Silah: We were with Ammar on the day when the appearance of the moon was doubtful. (The meat of) goat was brought to him. Some people kept aloof from (eating) it. Ammar said: He who keeps fast on this day disobeys AbulQasim (i.e. the Prophet) (ﷺ).

مَنْ صَامَ هَذَا الْيَوْمَ فَقَدْ عَصَى أَبَا الْقَاسِمِ صلى الله عليه وسلم ‏.‏

’Ammar bin Yasir (RAA) narrated, ‘Whoever fasts the day of doubt he has then disobeyed Abu al-Qasim (the Prophet).’ Related by the five Imams, and Ibn Khuzaimah and Ibn Hibban graded it as Sahih

‘Ammar b. Yasir said, "He who fasts on a day about which he is doubtful has disobeyed Abul Qasim"* *i.e., the Prophet. Abu Dawud, Tirmidhi, Nasa’i, Ibn Majah and Darimi transmitted it.
