حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ النُّفَيْلِيُّ، قَالَ قَرَأْتُ عَلَى مَعْقِلٍ عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنْ حُجْرٍ، عَنْ زَيْدِ بْنِ ثَابِتٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

مَنْ أَعْمَرَ شَيْئًا فَهُوَ لِمُعْمَرِهِ مَحْيَاهُ وَمَمَاتَهُ وَلاَ تُرْقِبُوا فَمَنْ أَرْقَبَ شَيئًا فَهُوَ سَبِيلُهُ ‏"

Narrated Zayd ibn Thabit:

The Prophet (ﷺ) said: If anyone gives something in life-tenancy, it belongs to the one to whom it is given, in his life and after his death; and do not give property to go to the survivor, for if anyone gives something to to to the survivor, it belongs to him.

Al-Azimabadi — Awn al-Ma'bud

( عَنْ حُجْرٍ ) : بِضَمِّ الْحَاء الْمُهْمَلَة وَسُكُون الْجِيم وَبِالرَّاءِ هُوَ اِبْن الْقَيْس الْهَمْدَانِيُّ الْمَدَرِيّ الْيَمَانِيّ ( مَنْ أَعْمَرَ ) : بِصِيغَةِ الْمَعْلُوم ( فَهُوَ ) : أَيْ فَذَلِكَ الشَّيْء ( لِمُعْمَرِهِ ) : بِفَتْحِ الْمِيم الثَّانِي اِسْم مَفْعُول مِنْ أَعْمَرَ ( مَحْيَاهُ وَمَمَاته ) : بِفَتْحِ الْمِيمَيْنِ أَيْ مُدَّة حَيَاته وَبَعْد مَوْته ( وَلَا تُرْقِبُوا ) : بِضَمِّ التَّاء وَسُكُون الرَّاء وَكَسْر الْقَاف أَيْ لَا تَجْعَلُوا أَمْوَالَكُمْ رُقْبَى وَلَا تُضَيِّعُوهَا وَلَا تُخْرِجُوهَا مِنْ أَمْلَاككُمْ بِالرُّقْبَى , فَالنَّهْي بِمَعْنَى أَنَّهُ لَا يَنْبَغِي لِلْإِنْسَانِ أَنْ يَفْعَلَ نَظَرًا إِلَى الْمَصْلَحَة , وَإِنْ فَعَلْتُمْ يَكُون صَحِيحًا ( فَمَ…

The Messenger of Allah said: "Whoever gives a life-long gift, it belongs to the one to whom he gave it, both during his life and after his death. And do not give things on the basis of Ruqba, for whoever is given something on the basis of Ruqba, it becomes part of his estate."

"Do not give property "to go to the survivor" and do not give "life-tenancy", for if anyone is given either, the property goes to his heirs."

وَلِأَبِي دَاوُدَ وَالنَّسَائِيِّ : { لَا تُرْقِبُوا , وَلَا تُعْمِرُوا، فَمَنْ أُرْقِبَ شَيْئًا أَوْ أُعْمِرَ شَيْئًا فَهُوَ لِوَرَثَتِهِ } 1‏ .‏ ‏1 ‏- صحيح .‏ رواه أبو داود ( 3556 )‏ ، والنسائي ( 6 / 273 )‏.‏

He reported the Prophet as saying, “Both life-tenancy and giving property which goes to the survivor are a gift which belongs to those who receive it." Ahmad, Tirmidhi and Abu Dawud transmitted it.

“I heard the Messenger of Allah (ﷺ) say: 'Whoever gives a lifelong grant to a man, it belongs to him (the recipient) and to his heirs. His (the giver's) words put an end to his right to it, and it belongs to the one to whom it was given for life and to his heirs.”
