Sunan Abu Dawud 3558

"The lifelong gift is permitted for its inhabitant, and the Ruqba is permitted for its inhabitant."

"‏ الْعُمْرَى جَائِزَةٌ لأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لأَهْلِهَا ‏"

Narrated by Jābir ibn ‘Abdullāh

"The Messenger of Allah said: 'Umra is permissible for the one to whom it is given, and Ruqba is permissible for the one to whom it is given.'"

"‏ الْعُمْرَى جَائِزَةٌ لأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لأَهْلِهَا ‏"

Narrated by Jābir ibn ‘Abdullāh

He reported the Prophet as saying, “Both life-tenancy and giving property which goes to the survivor are a gift which belongs to those who receive it." Ahmad, Tirmidhi and Abu Dawud transmitted it.

وَعَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لِأَهْلِهَا» . رَوَاهُ أَحْمد وَالتِّرْمِذِيّ وَأَبُو دَاوُد

"Keep your properties for yourselves and do not squander them, for if anyone gives a life-tenancy it goes to the one to whom it is given, both during his life and after his death, and to his descendants."

وَلِمُسْلِمٍ : { أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلَا تُفْسِدُوهَا , فَإِنَّهُ مَنْ أَعْمَرَ عُمْرَى فَهِيَ لِلَّذِي أُعْمِرَهَا حَياً وَمَيِّتًا، وَلِعَقِبِهِ } 1‏ .‏ ‏1 ‏- صحيح .‏ رواه مسلم ( 1625 )‏ ( 26 )‏.‏

"Do not give property "to go to the survivor" and do not give "life-tenancy", for if anyone is given either, the property goes to his heirs."

“I heard the Messenger of Allah (ﷺ) say: 'Whoever gives a lifelong grant to a man, it belongs to him (the recipient) and to his heirs. His (the giver's) words put an end to his right to it, and it belongs to the one to whom it was given for life and to his heirs.”
