Narrator:Abdullāh ibn ‘Umar

حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ، حَدَّثَنَا أَبُو قُتَيْبَةَ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏"‏ إِذَا

نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلاَهُ فَنِكَاحُهُ بَاطِلٌ ‏"

Ibn ‘Umar reported the Prophet (ﷺ) as saying “If a slave marries without the permission of his master, his marriage is null and void.

Abu Dawud said “This tradition is weak. This is mauquf(does not go back to the Prophet). This is the statement of the Ibn ‘Umar himself.

Al-Azimabadi — Awn al-Ma'bud

( حَدَّثَنَا عُقْبَة بْن مُكْرَم ) : بِضَمِّ الْمِيم وَإِسْكَان الْكَاف وَفَتْح الرَّاء الْمُهْمَلَة ( إِذَا نَكَحَ ) : أَيْ تَزَوَّجَ ( فَنِكَاحه بَاطِل ) : قَالَ الْخَطَّابِيّ : وَإِنَّمَا بَطَلَ نِكَاح الْعَبْد مِنْ أَجْل أَنَّ رَقَبَته وَمَنْفَعَته مَمْلُوكَتَانِ لِسَيِّدِهِ , وَهُوَ إِذَا اِشْتَغَلَ بِحَقِّ الزَّوْجَة لَمْ يَتَفَرَّغ لِخِدْمَةِ سَيِّده وَكَانَ فِي ذَلِكَ ذَهَاب حَقّه فَأَبْطَلَ النِّكَاح إِبْقَاء لِمَنْفَعَتِهِ عَلَى صَاحِبه اِنْتَهَى. وَالْحَدِيث حُجَّة لِمَنْ ذَهَبَ إِلَى بُطْلَان هَذَا النِّكَاح ( قَالَ أَبُو دَاوُدَ : هَذَا الْحَدِيث ضَعِيف إِلَخْ ) لِأَنَّ فِيهِ عَبْد اللَّه بْن عُمَر الْعُمَرِيّ وَهُوَ ضَعِيف , وَرَفْع هَذَا الْحَدِيث لَا يَصِحّ وَالصَّوَاب أَنَّه…

Allah's Messenger (ﷺ) said: "Any slave who marries without the permission of his masters or owners is (like) a fornicator." [Reported by Ahmad, Abu Dawud, an-Nasa'i and at-Tirmidhi; the latter graded it Sahih (authentic), as did Ibn Hibban].
