حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، أَخْبَرَنَا الْوَلِيدُ بْنُ مُسْلِمٍ، عَنْ زُهَيْرِ بْنِ مُحَمَّدٍ، عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏

"‏ أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ فَهُوَ عَاهِرٌ ‏"

Jabir bin Abdullah narrated that:

The Prophet said: "Whichever slave gets married without the permission of his owner, then he is a fornicator."

Classical commentary

Al-Mubarakfuri — Tuhfat al-Ahwadhi

قَوْلُهُ : ( بِغَيْرِ إِذْنِ سَيِّدِهِ ) أَيْ مَالِكِهِ ( فَهُوَ عَاهِرٌ ) أَيْ زَانٍ. قَالَ الْمُظْهِرُ : لَا يَجُوزُ نِكَاحُ الْعَبْدِ بِغَيْرِ إِذْنِ السَّيِّدِ ; وَبِهِ قَالَ الشَّافِعِيُّ وَأَحْمَدُ , وَلَا يَصِيرُ الْعَقْدُ صَحِيحًا عِنْدَهُمَا بِالْإِجَازَةِ بَعْدَهُ. وَقَالَ أَبُو حَنِيفَةَ وَمَالِكٌ : إِنْ جَازَ بَعْدَ الْعَقْدِ صَحَّ. قُلْت : اِحْتَجَّ مَنْ قَالَ بِبُطْلَانِ النِّكَاحِ وَعَدَمِ صِحَّتِهِ إِلَّا بِإِذْنِ السَّيِّدِ : بِأَنَّهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَكَمَ عَلَيْهِ بِأَنَّهُ عَاهِرٌ , وَالْعَاهِرُ : الزَّانِي , وَالزِّنَا بَاطِلٌ. وَبِرِوَايَةِ اِبْنِ عُمَرَ بِلَفْظِ : " إِذَا نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلَاهُ فَنِكَاحُهُ بَاطِلٌ " وَهُوَ حَدِيثٌ…

Allah's Messenger (ﷺ) said: "Any slave who marries without the permission of his masters or owners is (like) a fornicator." [Reported by Ahmad, Abu Dawud, an-Nasa'i and at-Tirmidhi; the latter graded it Sahih (authentic), as did Ibn Hibban].
