حَدَّثَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

لاَ يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ ‏"

Abu Hurairah reported the Apostle of Allaah(ﷺ) as saying “ A man should not seek the hand of a woman in marriage when his brother has already sought her hand.”

( لَا يَخْطُب الرَّجُل ) بِضَمِّ الْبَاء عَلَى أَنَّ لَا نَافِيَة وَبِكَسْرِهَا عَلَى أَنَّهَا نَاهِيَة. قَالَ السُّيُوطِيُّ : الْكَسْر وَالنَّصْب عَلَى كَوْنه نَهْيًا فَالْكَسْر لِكَوْنِهِ أَصْلًا فِي تَحْرِيك السَّاكِن وَالْفَتْح لِأَنَّهَا أَخَفّ الْحَرَكَات , وَأَمَّا الرَّفْع فَعَلَى كَوْنه نَفْيًا ذَكَرَهُ الْقَارِي فِي الْمِرْقَاة وَقَالَ وَالْفَتْح غَيْر مَعْرُوف رِوَايَة وَدِرَايَة ( عَلَى خِطْبَة أَخِيهِ ) : عَبَّرَ بِهِ لِلتَّحْرِيضِ عَلَى كَمَالِ التَّوَدُّد وَقَطْع صُوَر الْمُنَافَرَة , أَوْ لِأَنَّ كُلّ الْمُسْلِمِينَ إِخْوَة إِسْلَامًا. وَقَدْ ذَهَبَ الْجُمْهُور إِلَى أَنَّ النَّهْي فِي الْحَدِيث لِلتَّحْرِيمِ كَمَا حَكَى ذَلِكَ الْحَافِظ فِي فَتْح الْبَارِي. وَقَالَ الْخَطَّا…
