Narrator:Abdullāh ibn ‘Umar

أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏

"‏ أَيُّمَا امْرِئٍ أَبَّرَ نَخْلاً ثُمَّ بَاعَ أَصْلَهَا فَلِلَّذِي أَبَّرَ ثَمَرُ النَّخْلِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ‏"

It was narrated from Ibn 'Umar that the Prophet said:

"Any man who pollinates a date-palm tree then sells it, the fruits of the tree are for the one who pollinated it, unless the purchaser stipulated otherwise."

Reported by An-Nasa’i (No. 4635), Al-Bukhari (No. 2206) and Muslim (No. 1543c, 1543d).

Al-Sindi — Hashiyat al-Sindi on Sunan al-Nasa'i

قَوْله ( أَبَّرَ نَخْلًا ) مِنْ التَّأْبِير وَهُوَ التَّلْقِيح وَهُوَ أَنْ يَشُقّ طَلْع الْإِنَاث يُؤْخَذ مِنْ طَلْع الذُّكُور فَيُوضَع فِيهَا لِيَكُونَ الثَّمَر بِإِذْنِ اللَّه تَعَالَى أَجْوَد مِمَّا لَمْ يُؤَبَّر ( فَاَلَّذِي أَبَّرَ ) أَيْ لِلْبَائِعِ ( الْمُبْتَاع ) أَيْ الْمُشْتَرَى لِنَفْسِهِ وَقْت الْبَيْع.…

The Prophet (ﷺ) said, "Whoever pollinates date palms and then sells them, the fruits will belong to him unless the buyer stipulates that the fruits should belong to him (and the seller agrees).

أَيُّمَا امْرِئٍ أَبَّرَ نَخْلاً ثُمَّ بَاعَ أَصْلَهَا، فَلِلَّذِي أَبَّرَ ثَمَرُ النَّخْلِ، إِلاَّ أَنْ يَشْتَرِطَهُ الْمُبْتَاعُ ‏"

If pollinated date-palms are sold and nothing is mentioned (in the contract) about their fruits, the fruits will go to the person who has pollinated them, and so will be the case with the slave and the cultivator. Nafi' mentioned those three things.

أَيُّمَا، نَخْلٍ بِيعَتْ قَدْ أُبِّرَتْ لَمْ يُذْكَرِ الثَّمَرُ، فَالثَّمَرُ لِلَّذِي أَبَّرَهَا، وَكَذَلِكَ الْعَبْدُ وَالْحَرْثُ‏.‏ سَمَّى لَهُ نَافِعٌ هَؤُلاَءِ الثَّلاَثَ‏.‏

‘Abdallah b. ‘Umar reported God's Messenger as saying, “If anyone buys a slave and makes no stipulation about his property, he gets none of it.” Darimi transmitted it.

وَعَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنِ اشْتَرَى عَبْدًا فَلَمْ يَشْتَرِطْ مَاله فَلَا شَيْء لَهُ» . رَوَاهُ الدَّارمِيّ
