حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ حَدَّثَنَا الصَّعْبُ بْنُ جَثَّامَةَ، قَالَ سُئِلَ النَّبِيُّ صلى الله عليه وسلم

عَنْ أَهْلِ الدَّارِ مِنَ الْمُشْرِكِينَ يُبَيَّتُونَ فَيُصَابُ النِّسَاءُ وَالصِّبْيَانُ قَالَ ‏"‏ هُمْ مِنْهُمْ ‏"

It was narrated that Ibn ‘Abbas said:

“Sa’b bin Jaththamah said: ‘The Prophet (ﷺ) was asked about the polytheists who are attacked at night, and their women and children are killed.’ He said: ‘They are from among them.’”

Reported by Ibn Majah (No. 2839).

Al-Sindi — Hashiyat al-Sindi on Sunan Ibn Majah

قَوْله ( الصَّعْب ) بِفَتْحٍ فَسُكُون ( اِبْن جَثَّامَة ) بِفَتْحِ جِيم وَتَشْدِيد مُثَلَّثَة قَوْله ( عَنْ أَهْل الدَّار ) أَيْ الْقَرْيَة أَوْ الْمَحَلّ ( يُبَيَّتُونَ ) عَلَى بِنَاء الْمَفْعُول وَتَشْدِيد الْيَاء وَالضَّمِير لِأَهْلِ الدَّار أَيْ يَقَعُ الْمُسْلِمُونَ عَلَيْهِمْ لَيْلًا ( هُمْ مِنْهُمْ ) أَيْ مِنْ الْمُشْرِكِينَ فِي جَوَاز الْقَتْل فِي تَلِك الْحَالَة الْمَسْئُول عَنْهَا وَفِي ذَلِكَ الْقَتْل الْغَيْر الْقَصْدِيّ وَأَمَّا الْقَصْدِيُّ فَقَدْ نَهَى عَنْهُ فَلَا مُعَارَضَة بَيْن هَذَا الْحَدِيث وَحَدِيث النَّهْي وَالزُّهْرِيّ جَعَلَهُ مَنْسُوخًا بِحَدِيثِ النَّهْي…
