In brief
Salam is a sale in which the buyer pays the full price immediately and later receives precisely described goods. The Prophet ﷺ permitted it on condition that the measure, the weight and the term are known (al-Bukhari 2240, Muslim 1604). It finances agriculture and trade without interest.
The basic text
In Medina, people used to pay in advance for dates one or two years ahead. The Prophet ﷺ said that whoever pays in advance for something should do so for a known measure, a known weight and a known term (al-Bukhari 2240, Muslim 1604). Commentators have linked the verse of debt (al-Baqarah 2:282), which asks for debts with a term to be written down, to salam.
The conditions
- The price is paid in full at the time of the contract (with a few days’ leeway among the Malikis).
- The goods are described so as to avoid any dispute: kind, quality, quantity.
- The date and place of delivery are fixed.
- The goods must be of a type that is normally available at the agreed date.
The International Islamic Fiqh Academy confirmed it for modern uses (resolution 85 (2/9), Abu Dhabi, 1995): it may cover agricultural or industrial products or raw materials, and may be used to finance small producers. It specified that a penalty clause is not permitted for late delivery, because the goods are then a debt (resolution 109 (3/12)).
Parallel salam
A bank may buy a farmer’s harvest through salam, then sell goods of the same description to another client through a second salam, independent of the first. It may not resell the goods from the first contract before it has received them.
Salam and futures
Salam resembles a forward purchase, but with one decisive difference: the price is paid in advance and delivery actually takes place. Futures contracts on financial markets, where both payments are deferred and positions are often closed without delivery, are prohibited by the Academy (resolution 63 (1/7)), unless they meet the conditions of salam.

O you who have believed, when you contract a debt for a specified term, write it down. And let a scribe write [it] between you in justice. Let no scribe refuse to write as Allāh has taught him. So let him write and let the one who has the obligation [i.e., the debtor] dictate. And let him fear Allāh, his Lord, and not leave anything out of it. But if the one who has the obligation is of limited understanding or weak or unable to dictate himself, then let his guardian dictate in justice. And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses - so that if one of them [i.e., the women] errs, then the other can remind her. And let not the witnesses refuse when they are called upon. And do not be [too] weary to write it, whether it is small or large, for its [specified] term. That is more just in the sight of Allāh and stronger as evidence and more likely to prevent doubt between you, except when it is an immediate transaction which you conduct among yourselves. For [then] there is no blame upon you if you do not write it. And take witnesses when you conclude a contract. Let no scribe be harmed or any witness. For if you do so, indeed, it is [grave] disobedience in you. And fear Allāh. And Allāh teaches you. And Allāh is Knowing of all things.
The hadiths
The Prophet (ﷺ) came to Medina and the people used to pay in advance the price of dates to be delivered within two or three years. He said (to them), "Whoever pays in advance the price of a thing to be delivered later should pay it for a specified measure at specified weight for a specified period."
مَنْ أَسْلَفَ فِي شَىْءٍ فَفِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ، إِلَى أَجَلٍ مَعْلُومٍ ".

‘Abdullāh ibn ‘Abbās (may Allah be pleased with him) reported that when the Messenger of Allah (may Allah's peace and blessings be upon him) came to Madīnah, they used to pay one, two or three years in advance for fruits, so he said: "Whoever pays in advance for anything, let him pay for a…
