حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏

"‏ الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ ‏"

Narrated Abu Hurairah:

that the Messenger of Allah (ﷺ) said: "The injuries caused by the animal are without liability, and wells are without liability, and mines are without liability, and the Khumus is due on Rikaz." (Another Chain) from Abu Hurairah, from the Prophet (ﷺ) with similar meaning.

قَوْلُهُ : ( الْعَجْمَاءِ ) بِفَتْحِ الْعَيْنِ مَمْدُودًا سُمِّيَتْ عَجْمَاءَ لِأَنَّهَا لَا تَتَكَلَّمُ ( جُرْحُهَا ) بِضَمِّ الْجِيمِ وَفَتْحِهَا فَبِالْفَتْحِ مَصْدَرٌ وَبِالضَّمِّ الِاسْمُ ( جُبَارٌ ) بِضَمِّ الْجِيمِ وَتَخْفِيفِ الْمُوَحَّدَةِ أَيْ هَدَرٌ لَا شَيْءَ فِيهِ ( وَالْبِئْرُ ) بِالْهَمْزَةِ وَيُبْدَلُ ( جُبَارٌ ) فَمَنْ حَفَرَ بِيرًا فِي أَرْضِهِ أَوْ فِي أَرْضِ الْمُبَاحِ وَسَقَطَ فِيهِ رَجُلٌ لَا قَوَدَ وَلَا عَقْلَ عَلَى الْحَافِرِ , وَكَذَلِكَ الْمَعْدِنُ قَالَهُ الْقَارِي. Allah's Messenger (ﷺ) said, "No bloodmoney will be charged if somebody dies in a mine or in a well or is killed by an animal; and if somebody finds a treasure in his land he has to give one-fifth of it to the Government."

There is no compensation for one killed or wounded by an animal or by falling in a well or because of working in a mine, and one fifth is due on the buried treasure

Allah's Messenger (ﷺ) said, "There is no Diya for persons killed by animals or for the one who has been killed accidentally by falling into a well or for the one killed in a mine. And one-fifth of Rikaz (treasures buried before the Islamic era) is to be given to the state."

No requital is payable for a wound caused by an animal, for (falling into) a well and a mine, and one-fifth (is the share of the government) in the buried treasure (treasure-trove).
