حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، وَأَبِي، سَلَمَةَ سَمِعَا أَبَا هُرَيْرَةَ، يُحَدِّثُ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏

الْعَجْمَاءُ جَرْحُهَا جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَالْبِئْرُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ ‏"

Narrated Abu Hurairah:

The Messenger of Allah (ﷺ) as saying: No retaliation is payable for a wound caused by a dumb animal, for a mine, and for a well. On the treasure found buried in the land there is a fifth.

Abu Dawud said: A dumb animal means an animal which is free and has not tether, and there is no one (as a watchman) with it. It causes harm by day and not by night.

( الْعَجْمَاء ) : أَيْ الْبَهِيمَة وَالدَّابَّة وَسُمِّيَتْ بِهَا لِعُجْمَتِهَا وَكُلّ مَنْ لَمْ يَقْدِر عَلَى الْكَلَام فَهُوَ أَعْجَمِيّ ( جَرْحهَا ) : بِفَتْحِ الْجِيم عَلَى الْمَصْدَر لَا غَيْر قَالَهُ الْأَزْهَرِيّ , وَأَمَّا بِالضَّمِّ فَهُوَ الِاسْم كَذَا فِي النِّهَايَة وَالْقَامُوس ( جُبَار ) : بِضَمِّ الْجِيم أَيْ هَدَر. قَالَ الْخَطَّابِيُّ : وَإِنَّمَا يَكُون جَرْحهَا هَدَرًا إِذَا كَانَتْ مُنْفَلِتَة عَائِرَة عَلَى وَجْههَا لَيْسَ لَهَا قَائِد وَلَا سَائِق وَلَا عَلَيْهَا رَاكِب ( وَالْمَعْدِن ) : بِكَسْرِ الدَّال ( جُبَار ) : مَعْنَاهُ أَنَّ الرَّجُل يَحْفِر الْمَعْدِن فِي مِلْكه أَوْ فِي مَوَات فَيَمُرّ بِهَا مَارّ فَيَسْقُط فِيهَا فَيَمُوت , أَوْ يَسْتَأْجِر أُجَرَاء يَعْمَلُ…

Allah's Messenger (ﷺ) said, "No bloodmoney will be charged if somebody dies in a mine or in a well or is killed by an animal; and if somebody finds a treasure in his land he has to give one-fifth of it to the Government."

There is no compensation for one killed or wounded by an animal or by falling in a well or because of working in a mine, and one fifth is due on the buried treasure

Allah's Messenger (ﷺ) said, "There is no Diya for persons killed by animals or for the one who has been killed accidentally by falling into a well or for the one killed in a mine. And one-fifth of Rikaz (treasures buried before the Islamic era) is to be given to the state."

No requital is payable for a wound caused by an animal, for (falling into) a well and a mine, and one-fifth (is the share of the government) in the buried treasure (treasure-trove).
