أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، قَالَ حَدَّثَنَا أَبُو دَاوُدَ الْحَفَرِيُّ، عَنْ سُفْيَانَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏

"‏ لَيْسَ عَلَى خَائِنٍ وَلاَ مُنْتَهِبٍ وَلاَ مُخْتَلِسٍ قَطْعٌ ‏"

Jābir (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: “Cutting (off hands) does not apply to a traitor, an usurper, or an embezzler.”

Explanation

Allah enjoined cutting off a thief's hand as a legal punishment for the crime of theft. However, this punishment is not applicable to other similar crimes, such as embezzlement, extortion, or usurpation. The rationale behind this distinction is that the occurrence of these crimes is rare compared with theft. Also, the condition for cutting off a hand, which is taking an object from its secure place, may be inapplicable to or may differ in these crimes. Furthermore, in other crimes the object taken could be returned through the ruler (competent authority), because the evidence against the culprit could easily be established. On the other hand, the punishment for theft is grave, because it involves taking something secretly from its secure place.

شرع الله تعالى إيجاب قطع يد السارق عقوبة عَلَى جريمة السرقة، ولم يجعل ذلك فِي غيرها، كالاختلاس، والانتهاب، والغصب؛ والحكمة في ذلك أن أخذ المال بهذه الطرق قليلٌ بالنسبة إلى السرقة، ولأن شرط القطع -وهو أخذ الشيء من الحرز- قد تخلف في هذه الصور، كما أن استرجاع المال فيها ممكن بالاستعانة بالحاكم، لسهولة إقامة البينة على الحق، بخلاف السرقة فلكونها أخذا للشيء من الحرز على سبيل التخفي عظم الشارع أمرها، وشدد في عقوبتها؛ ليكون ذلك أبلغ فِي الزجر عنها.

  • أنه لا قطع في حق هؤلاء، وهم الخائن والمنتهب والمختلس، وهو قول جمهور العلماء، بل حكي الإجماع على ذلك.
  • الحكمة في عدم إقامة الحد عليهم أنَّ ذلك قليلٌ بالنسبة إلى السرقة، ولأنه تخلف في حقهم شرط إقامة حد السرقة وهو الأخذ من الحرز، ولأنه يمكن استرجاع هَذَا النوع بِاسْتِعْدَاءِ ولاة الأمور، ويسهُلُ إقامة البينة عليه، بخلاف السرقة، فيعظم أمرها.

He reported the Prophet as saying, “Cutting off the hand is not to be inflicted on one who is treacherous, one who plunders, or one who snatches something.” Tirmidhi, Nasa’i, Ibn Majah and Darimi transmitted it.

وَعَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَيْسَ عَلَى خَائِنٍ وَلَا مُنْتَهِبٍ وَلَا مُخْتَلِسٍ قَطْعٌ» . رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَهْ والدارمي
