حَدَّثَنَا إِسْمَاعِيلُ حَدَّثَنَا أَيُّوبُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ أَعْتَقَ نَصِيبًا أَوْ قَالَ شَقِيصًا لَهُ أَوْ قَالَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مِنْ الْمَالِ مَا بَلَغَ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ فَهُوَ عَتِيقٌ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ قَالَ أَيُّوبُ كَانَ نَافِعٌ رُبَّمَا قَالَ فِي هَذَا الْحَدِيثِ وَرُبَّمَا لَمْ يَقُلْهُ فَلَا أَدْرِي أَهُوَ فِي الْحَدِيثِ أَوْ قَالَهُ نَافِعٌ مِنْ قِبَلِهِ يَعْنِي قَوْلَهُ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ

The Prophet (ﷺ) said, "He who manumits his share of a slave and has money sufficient to free the remaining portion of that slave's price (justly estimated) then he should manumit him (by giving the rest of his price to the other co-owners)." Nafi` added, "Otherwise the slave is partially free."…

Abul Malih told on his father's authority that when a man emancipated a share in a slave, and the matter was mentioned to the Prophet he said, “God has no partner,” and decided chat he should be emancipated. Abu Dawud transmitted it.

وَعَن الْمَلِيحِ عَنْ أَبِيهِ: أَنَّ رَجُلًا أَعْتَقَ شِقْصًا مِنْ غُلَامٍ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لَيْسَ لِلَّهِ شَرِيكٌ» فَأَجَازَ عتقه. رَوَاهُ أَبُو دَاوُد

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.
