حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى الرَّازِيُّ، أَخْبَرَنَا عِيسَى بْنُ يُونُسَ، حَدَّثَنَا عُبَيْدُ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

مَنْ أَعْتَقَ شِرْكًا مِنْ مَمْلُوكٍ لَهُ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَا يَبْلُغُ ثَمَنَهُ وَإِنْ لَمْ يَكُنْ لَهُ مَالٌ عَتَقَ نَصِيبُهُ ‏"

Ibn 'Umar reported the Messenger of Allah (ﷺ) as saying:

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

Reported by Abu Dawud (No. 3943), Al-Bukhari (No. 2523), Muslim (No. 1501d) and Ahmad (No. 5997, 6164).

Al-Azimabadi — Awn al-Ma'bud

( شِرْكًا ) : بِكَسْرِ الْمُعْجَمَة وَسُكُون الرَّاء , وَفِي رِوَايَة أَيُّوب عَنْ نَافِع شِقْصًا , وَفِي أُخْرَى عَنْ أَيُّوب أَيْضًا وَكِلَاهُمَا فِي الْبُخَارِيّ عَنْ نَافِع نَصِيبًا وَالْكُلّ بِمَعْنًى. وَالشِّرْك فِي الْأَصْل مَصْدَر أُطْلِقَ عَلَى مُتَعَلِّقه وَهُوَ الْعَبْد الْمُشْتَرَك , قَالَهُ الزُّرْقَانِيُّ ( فَعَلَيْهِ ) : أَيْ مَنْ أَعْتَقَ نَصِيبًا لَهُ ( عِتْقه ) : أَيْ عِتْق الْمَمْلُوك ( كُلّه ) : بِالْجَرِّ لِأَنَّهُ تَأْكِيد لِقَوْلِهِ فِي مَمْلُوك. قَالَهُ الْعَيْنِيّ ( إِنْ كَانَ لَهُ مَا ) : بِلَا لَام أَيْ شَيْء , وَفِي بَعْض النُّسَخ مَال هُوَ مَا يُتَمَوَّل , وَالْمُرَاد بِهِ هُنَا مَا يَسَعُ نَصِيب الشَّرِيك , وَيُبَاع عَلَيْهِ فِي ذَلِكَ مَا يُبَاع عَلَى الْمُفْلِ…

He who emancipates his share in the slave, it is his responsibility to secure full freedom for him provided he (the slave) has enough money to pay the (remaining) price, but it he has not so much money he would be emancipated to the extent that the first man emancipated.

Abul Malih told on his father's authority that when a man emancipated a share in a slave, and the matter was mentioned to the Prophet he said, “God has no partner,” and decided chat he should be emancipated. Abu Dawud transmitted it.
