‘Ā'ishah (may Allah be pleased with her) reported: This verse: {Allah does not impose blame upon you for what is unintentional in your oaths} [Sūrat al-Baqarah: 225) was revealed concerning saying: "No, by Allah" and "Yes, by Allah".
Allah, the Almighty, says what means: {Allah does not impose blame upon you for what is unintentional in your oaths} [Sūrat al-Baqarah: 225]. According to ‘Ā'ishah (may Allah be pleased with her) the unintentional oath in this verse means what people usually say during their conversations with no intention of making an oath such as: "No, by Allah" and "Yes, by Allah". This ruling also applies to oaths that people make concerning past events, based on wrong assumptions.
Similarly, anyone who makes an oath believing that he is right, but then finds out that it is otherwise, does not have to offer expiation because it is an invalid oath according to the verse: {Allah does not impose blame upon you for what is unintentional in your oaths} [Sūrat al-Baqarah: 225]. According to this verse, Allah, the Almighty, will not punish people or make it binding on them to offer expiation for such unintentional oaths.
The same ruling applies to making an oath that someone would do something, believing that he is going to honor that oath, but he does not. Of course, this ruling applies with priority to the example mentioned by ‘Ā'ishah (may Allah be pleased with her) as she was present at the time of the revelation, and she was also knowledgeable about the language of the Arabs.
Explanation in Arabic
قال تعالى : {لَا يُؤَاخِذُكُمُ الله بِاللَّغْوِ في أَيْمَانِكُمْ} [المائدة: 89] فسَّرت عائشة رضي الله عنها لغو اليمين هنا: بأنَّه ما يتردَّد على ألسنة النّاس أثناء المحادثة عن قولهم: لا والله، وبلى والله، ممَّا يجري على اللسان، ولا يقصده القلب؛ وكذلك من لغو اليمين المذكور في الآية حلف الإنسان على أمرٍ ماضٍ يظنه كما قال، فبان بخلاف ما ظن.
وكذا يمين عقدها يظن صدق نفسه، فبان خلافه، فلغو غير منعقدة، ولا كفَّارة فيها لقوله تعالى : {لَا يُؤَاخِذُكُمُ الله بِاللَّغْوِ في أَيْمَانِكُمْ} أي: لا يعاقبكم، ولا يلزمكم كفَّارة بما صدر منكم من الأيمان التي لا يقصدها الحالف.
وكذا لو عقدها ظانًّا صدقه، فلم يكن، كمن حلف على غيره يظن أنَّه يطيعه، فلم يفعل، وأولى ما يدخل في الآية تفسير عائشة رضي الله عنها ؛ لأنها شاهدت التنزيل وهي عارفة بلغة العرب.
ما يجري على لسان المتكلِّم بدون قصد؛ كـ"لا والله" و"بلى والله" لغو.
إذا حلف على أمرٍ ماض يظن صدق نفسه، فبان بخلافه، فهو لغو.
لغو اليمين ليس فيه كفارة ولا إثم باتفاق.
يقاس على الحديث إذا جرى على اللسان الحلف بغير الله؛ لكن ينهى عنه لئلا يغتر به من يسمعه.
يلحق به من طلق زوجته بغير قصد؛ لكن الحاكم لا يحكم إلا بالظاهر إذا رفع إليه.
وعن عائشة رضي الله عنها قالت: أنزلت هذه الآية: {لا يؤاخذكم الله باللغو في أيمانكم} في قول الرجل: لا والله، وبلى والله. ((رواه البخاري)).
