حَدَّثَنَا آدَمُ، قَالَ حَدَّثَنَا شُعْبَةُ، عَنِ الأَعْمَشِ، عَنْ أَبِي وَائِلٍ، عَنْ حُذَيْفَةَ، قَالَ أَتَى النَّبِيُّ صلى الله عليه وسلم سُبَاطَةَ قَوْمٍ فَبَالَ قَائِمًا،

ثُمَّ دَعَا بِمَاءٍ، فَجِئْتُهُ بِمَاءٍ فَتَوَضَّأَ‏.‏

Narrated Hudhaifa:

Once the Prophet (ﷺ) went to the dumps of some people and passed urine while standing. He then asked for water and so I brought it to him and he performed ablution.

Explanation in Arabic

جاء النبي صلى الله عليه وسلم إلى موضع تُلقى فيه الكناسة ونحوها، وإضافتها إلى القوم إضافة اختصاص لا ملك؛ لأنها كانت بفناء دورهم، فأضيف إليهم لقربها منهم، وهي مجمع المهملات؛ ولهذا بال صلى الله عليه وسلم فيها، وتكون في الغالب سهلة لا يرتد منها البول على البائل، فبال عليه الصلاة والسلام وهو قائم، ثم سأل حذيفة رضي الله عنه أن يعطيه ماءً، فجاءه حذيفة بماءٍ فتوضأ، ولعله صلى الله عليه وسلم بال بالرقب من الناس ولم يتباعد كما كان يفعل؛ لأنه كان مشغولًا، ولأن الإبعاد يكون لخروج الغائط، وكان حذيفة رضي الله عنه قريبًا ليستر النبي عليه الصلاة والسلام.

  • جواز البول قائمًا، والكراهة فيه كراهة تنزيه لا تحريم.
  • جواز البول بالقرب من الديار حيث لا يتأذى به أحد.
  • أن مدافعة البول ومصابرته مكروهة؛ لما فيه من الضرر.
  • جواز البول في سباطة الناس بغير إذنهم؛ لجريان العادة بذلك.
  • جواز قرب الإنسان من البائل إذا كان يستره.
  • بيان أن البول ينقض الوضوء.

قَوْله : ( عَنْ أَبِي وَائِل ) وَلِأَبِي دَاوُد الطَّيَالِسِيّ فِي مُسْنَدِهِ عَنْ شُعْبَةَ عَنْ الْأَعْمَشِ أَنَّهُ سَمِعَ أَبَا وَائِل وَلِأَحْمَدَ عَنْ يَحْيَى الْقَطَّان عَنْ الْأَعْمَشِ حَدَّثَنِي أَبُو وَائِل. قَوْله : ( سُبَاطَة قَوْم ) بِضَمِّ الْمُهْمَلَةِ بَعْدَهَا مُوَحَّدَة هِيَ الْمَزْبَلَةُ وَالْكُنَاسَةُ تَكُونُ بِفِنَاءِ الدُّورِ مِرْفَقًا لِأَهْلِهَا وَتَكُونُ فِي الْغَالِبِ سَهْلَة لَا يَرْتَدُّ فِيهَا الْبَوْل عَلَى الْبَائِلِ وَإِضَافَتهَا إِلَى الْقَوْمِ إِضَافَة اِخْتِصَاصٍ لَا مِلْكٍ ; لِأَنَّهَا لَا تَخْلُو عَنْ النَّجَاسَةِ وَبِهَذَا يَنْدَفِعُ إِيرَاد مَنْ اسْتَشْكَلَهُ لِكَوْن الْبَوْل يُوهِي الْجِدَار فَفِيهِ إِضْرَار أَوْ نَقُولُ : إِنَّمَا بَالَ فَوْقَ السُّبَاط…
