حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، وَمُحَمَّدُ بْنُ أَبِي السَّرِيِّ الْعَسْقَلاَنِيُّ، - وَهَذَا لَفْظُهُ وَهُوَ أَتَمُّ - قَالاَ حَدَّثَنَا ابْنُ نُمَيْرٍ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ أَيُّوبَ بْنِ مُوسَى عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

قَطَعَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَدَ رَجُلٍ فِي مِجَنٍّ قِيمَتُهُ دِينَارٌ أَوْ عَشْرَةُ دَرَاهِمَ ‏.‏

Narrated Abdullah ibn Abbas:

The Messenger of Allah (ﷺ) had a man's hand cut off for (stealing) a shield whose price was a dinar or ten dirhams.

Abu Dawud said: Muhammad bin Salamah and Sa'dan bin Yahya have transmitted it from Ibn Ishaq through his chain of narrators.

Al-Azimabadi — Awn al-Ma'bud

( وَهَذَا لَفْظه ) : أَيْ مُحَمَّد بْن أَبِي السَّرِيّ ( وَهُوَ أَتَمّ ) : أَيْ لَفْظ رِوَايَة مُحَمَّد بْن أَبِي السَّرِيّ أَتَمّ مِنْ لَفْظ رِوَايَة عُثْمَان بْن أَبِي شَيْبَة ( قِيمَته دِينَار أَوْ عَشَرَة دَرَاهِم ) : اِحْتَجَّ بِهِ أَبُو حَنِيفَة رَحِمَهُ اللَّه وَأَصْحَابه وَسَائِر فُقَهَاء الْعِرَاق عَلَى أَنَّ النِّصَاب الْمُوجِب لِلْقَطْعِ هُوَ عَشَرَة دَرَاهِم وَلَا قَطْع فِي أَقَلّ مِنْ ذَلِكَ. وَأَخْرَجَهُ الْبَيْهَقِيُّ وَالطَّحَاوِيّ بِلَفْظِ " كَانَ ثَمَن الْمِجَنّ عَلَى عَهْد رَسُول اللَّه صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ يُقَوَّم عَشَرَة دَرَاهِم " وَأَخْرَجَهُ نَحْو ذَلِكَ النَّسَائِيُّ. وَأَخْرَجَ الْبَيْهَقِيُّ عَنْ مُحَمَّد بْن إِسْحَاق عَنْ عَمْرو بْن شُعَيْب عَنْ أَبِي…

A thief’s hand should be cut off for a quarter of a dinar and upwards. Ahmed b. Salih said: The amputation (of a thief’s hand) is for a quarter of a dinar and upwards.

'A'isha reported that during the lifetime of Allah's Messenger (ﷺ) the hand of the thief was not cut off for less than the price of a shield, iron coat or armour and both of them are valuable.

لَمْ تُقْطَعْ يَدُ سَارِقٍ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي أَقَلَّ مِنْ ثَمَنِ الْمِجَنِّ حَجَفَةٍ أَوْ تُرْسٍ وَكِلاَهُمَا ذُو ثَمَنٍ ‏.‏

The hand of a thief was not cut off during the lifetime of the Prophet (ﷺ) except for stealing something equal to a shield in value. A similar hadith is narrated from `Aisha through another chain.
