حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ خَالِدٍ، عَنْ أَبِي بِشْرٍ الْعَنْبَرِيِّ، عَنِ ابْنِ التَّلِبِّ، عَنْ أَبِيهِ، أَنَّ رَجُلاً،

أَعْتَقَ نَصِيبًا لَهُ مِنْ مَمْلُوكٍ فَلَمْ يُضَمِّنْهُ النَّبِيُّ صلى الله عليه وسلم ‏.‏

Narrated ath-Thalabb:

On the authority of his father: A man emancipated his share in a slave. The Prophet (ﷺ) did not put the responsibility on him to emancipate the rest.

Ahmad said: The name Ibn al-Thalabb is to be pronounced with a ta' (and not with tha). As Shu'bah could not pronounce ta, he said tha.

Al-Azimabadi — Awn al-Ma'bud

( عَنْ اِبْن التَّلِب ) : اِسْمه مِلْقَام. قَالَ فِي التَّقْرِيب مِلْقَام بِكَسْرِ أَوَّله وَسُكُون اللَّام ثُمَّ قَاف وَيُقَال بِالْهَاءِ بَدَل الْمِيم اِبْن التَّلِب بِفَتْحِ الْمُثَنَّاة وَكَسْر اللَّام وَتَشْدِيد الْمُوَحَّدَة التَّمِيمِيّ الْعَنْبَرِيّ مَسْتُور مِنْ الْخَامِسَة اِنْتَهَى. قَالَ الْمُنْذِرِيُّ : وَابْن التَّلِب اِسْمه مِلْقَام وَيُقَال فِيهِ هِلْقَام وَأَبُوهُ يُكَنَّى أَبَا الْمِلْقَام قَالَ النَّسَائِيُّ يَنْبَغِي أَنْ يَكُون مِلْقَام بْن التَّلِب لَيْسَ بِالْمَشْهُورِ وَقَالَ الْبَيْهَقِيُّ إِسْنَاده غَيْر قَوِيّ اِنْتَهَى. وَفِي الْإِصَابَة التَّلِب بْن ثَعْلَبَة لَهُ صُحْبَة وَأَحَادِيث رَوَى لَهُ أَبُو دَاوُدَ وَالنَّسَائِيُّ وَقَدْ اِسْتَغْفَرَ لَهُ رَسُول اللَّه…

Abul Malih told on his father's authority that when a man emancipated a share in a slave, and the matter was mentioned to the Prophet he said, “God has no partner,” and decided chat he should be emancipated. Abu Dawud transmitted it.

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

The Prophet (ﷺ) said, "If one manumits his share of a common slave (Abd), and he has money sufficient to free the remaining portion of the price of the slave (justly estimated), then he should free the slave completely by paying the rest of his price; otherwise the slave is freed partly. "
