حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ سَالِمٍ، عَنْ أَبِيهِ، يَبْلُغُ بِهِ النَّبِيَّ صلى الله عليه وسلم ‏"

‏ إِذَا كَانَ الْعَبْدُ بَيْنَ اثْنَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَإِنْ كَانَ مُوسِرًا يُقَوَّمُ عَلَيْهِ قِيمَةً لاَ وَكْسَ وَلاَ شَطَطَ ثُمَّ يُعْتَقُ ‏"

Ibn 'Umar reported the Prophet (ﷺ) as saying:

If a man is shared by two men, and one of them emancipates his share, a price of the slave will be fixed, not more or less, and he will be emancipated by him in case he is rich.

Al-Azimabadi — Awn al-Ma'bud

( يُقَوَّم ) : بِصِيغَةِ الْمَجْهُول ( لَا وَكْس ) : بِفَتْحِ الْوَاو وَسُكُون الْكَاف بَعْدهَا مُهْمَلَة بِمَعْنَى النَّقْص أَيْ لَا نَقْص ( وَلَا شَطَط ) : بِمُعْجَمَةٍ ثُمَّ مُهْمَلَة مُكَرَّرَة وَالْفَتْح أَيْ لَا جَوْر وَلَا ظُلْم ( ثُمَّ يُعْتَق ) : بِصِيغَةِ الْمَجْهُول. وَلَفْظ مُسْلِم ثُمَّ أُعْتِقَ عَلَيْهِ مِنْ0 مَاله إِنْ كَانَ مُوسِرًا. قَالَ الْحَافِظ : وَاتَّفَقَ مَنْ قَالَ مِنْ الْعُلَمَاء عَلَى أَنَّهُ يُبَاع عَلَيْهِ فِي حِصَّة شَرِيكه جَمِيع مَا يُبَاع عَلَيْهِ فِي الدِّين عَلَى اِخْتِلَاف عِنْدهمْ فِي ذَلِكَ , وَلَوْ كَانَ عَلَيْهِ دَيْن يُقَدَّر مَا يَمْلِكهُ كَانَ فِي حُكْم الْمُوسِر عَلَى أَصَحّ قَوْلَيْ الْعُلَمَاء وَهُوَ كَالْخِلَافِ فِي أَنَّ الدَّيْن هَلْ يَمْنَع ا…

Abul Malih told on his father's authority that when a man emancipated a share in a slave, and the matter was mentioned to the Prophet he said, “God has no partner,” and decided chat he should be emancipated. Abu Dawud transmitted it.

وَعَن الْمَلِيحِ عَنْ أَبِيهِ: أَنَّ رَجُلًا أَعْتَقَ شِقْصًا مِنْ غُلَامٍ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لَيْسَ لِلَّهِ شَرِيكٌ» فَأَجَازَ عتقه. رَوَاهُ أَبُو دَاوُد

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

The Prophet (ﷺ) said, "If one manumits his share of a common slave (Abd), and he has money sufficient to free the remaining portion of the price of the slave (justly estimated), then he should free the slave completely by paying the rest of his price; otherwise the slave is freed partly. "
