حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ، حَدَّثَنَا شُعْبَةُ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏

جَارُ الدَّارِ أَحَقُّ بِدَارِ الْجَارِ أَوِ الأَرْضِ ‏"

Narrated Samurah:

The Prophet (ﷺ) said: A neighbour has the best claim to the house or land of the neighbour.

Reported by Abu Dawud (No. 3517).

( جَار الدَّار أَحَقّ إِلَخْ ) : قَالَ الْخَطَّابِيّ : وَهَذَا أَيْضًا قَدْ يُحْتَمَل أَنْ يَتَنَاوَل عَلَى الْجَار الْمُشَارِك دُون الْمُقَاسِم كَمَا قُلْنَا فِي الْحَدِيث الْأَوَّل , وَقَدْ تَكَلَّمُوا فِي إِسْنَاده. قَالَ يَحْيَى بْن مَعِين : لَمْ يَسْمَع الْحَسَن مِنْ سَمُرَة وَإِنَّمَا هُوَ صَحِيفَة وَقَعَتْ إِلَيْهِ أَوْ كَمَا قَالَ , وَقَالَ غَيْره : سَمِعَ الْحَسَن مِنْ سَمُرَة حَدِيث الْعَقِيقَة اِنْتَهَى. قَالَ الْمُنْذِرِيّ : وَأَخْرَجَهُ التِّرْمِذِيّ وَالنَّسَائِيّ , وَقَالَ التِّرْمِذِيّ حَسَن صَحِيح هَذَا آخِر كَلَامه. وَقَدْ تَقَدَّمَ اِخْتِلَاف الْأَئِمَّة فِي سَمَاع الْحَسَن عَنْ سَمُرَة وَالْأَكْثَر عَلَى أَنَّهُ لَمْ يُسْمَع مِنْهُ إِلَّا حَدِيث الْعَقِيقَة.…
