Narrator:Abdullāh ibn ‘Umar

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنِ ابْنِ عُمَرَ، قَالَ رَأَيْتُ النَّاسَ يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم

إِذَا اشْتَرَوُا الطَّعَامَ جُزَافًا أَنْ يَبِيعُوهُ حَتَّى يُبْلِغَهُ إِلَى رَحْلِهِ ‏.‏

Narrated Ibn 'Abbas:

I saw that during the time of the Messenger of Allah (ﷺ) the people were beaten when they bought grain on the same spot and sold it there without moving it to their houses.

Al-Azimabadi — Awn al-Ma'bud

( يُضْرَبُونَ ) : بِصِيغَةِ الْمَجْهُول. قَالَ السُّيُوطِيُّ : هَذَا أَصْل فِي ضَرْب الْمُحْتَسِب أَهْل السُّوق إِذَا خَالَفُوا الْحُكْم الشَّرْعِيّ فِي مُبَايَعَاتهمْ وَمُعَامَلَاتهمْ اِنْتَهَى. قَالَ النَّوَوِيّ : فِيهِ دَلِيل عَلَى أَنَّ وَلِيّ الْأَمْر يُعَزِّر مَنْ تَعَاطَى بَيْعًا فَاسِدًا , وَيُعَزِّرهُ بِالضَّرْبِ وَغَيْره مِمَّا يَرَاهُ مِنْ الْعُقُوبَات فِي الْبَدَن اِنْتَهَى. ( جُزَافًا ) : أَيْ شِرَاء جُزَافًا , وَيَجُوز أَنْ يَكُون بِالنَّصْبِ عَلَى الْحَال أَيْ حَال كَوْنهمْ مُجَازِفِينَ. قَالَ الْقُرْطُبِيّ : فِي هَذَا الْحَدِيث دَلِيل لِمَنْ سَوَّى بَيْن الْجُزَاف وَالْكَيْل مِنْ الطَّعَام فِي الْمَنْع مِنْ بَيْع ذَلِكَ حَتَّى يَقْبِض وَرَأَى نَقْل الْجُزَاف قَبْضه , وَبِهِ ق…

Ibn ‘Umar said they used to buy grain in the upper part of the market and sell it in the same spot, but God’s Messenger forbade them to sell it there before removing it. Abu Dawud transmitted it. I have not found it in the two Sahihs.

that his father said. "I saw those, who used to buy foodstuff without measuring or weighing in the life time of the Prophet (ﷺ) being punished if they sold it before carrying it to their own houses."

رَأَيْتُ الَّذِينَ يَشْتَرُونَ الطَّعَامَ مُجَازَفَةً يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنْ يَبِيعُوهُ حَتَّى يُئْوُوهُ إِلَى رِحَالِهِمْ‏.‏
