حَدَّثَنَا أَبُو سَلَمَةَ، مُوسَى بْنُ إِسْمَاعِيلَ حَدَّثَنَا حَمَّادٌ، عَنْ قَيْسٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ قَالَ يَا زَيْدُ بْنَ أَرْقَمَ هَلْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أُهْدِيَ إِلَيْهِ عُضْوُ صَيْدٍ فَلَمْ يَقْبَلْهُ وَقَالَ ‏"‏

إِنَّا حُرُمٌ ‏"‏ ‏.‏ قَالَ نَعَمْ

Ibn ‘Abbas said Zaid bin ‘Arqam do you know that the limb of a game was presented to the Apostle of Allaah(ﷺ) but he did not accept it. He said “We are wearing ihram”. He replied, Yes.

Reported by Abu Dawud (No. 1850).

( فَلَمْ يَقْبَلهُ وَقَالَ أَنَا حُرُم ) : وَقَدْ اِسْتَدَلَّ بِهَذَا مَنْ قَالَ بِتَحْرِيمِ الْأَكْل مِنْ لَحْم الصَّيْد عَلَى الْمُحْرِم مُطْلَقًا لِأَنَّهُ اِقْتَصَرَ فِي التَّعْلِيل عَلَى كَوْنه مُحْرِمًا فَدَلَّ عَلَى أَنَّهُ سَبَب الِامْتِنَاع خَاصَّة وَهُوَ قَوْل عَلِيّ وَابْن عَبَّاس وَابْن عُمَر وَاللَّيْث وَالثَّوْرِيِّ وَإِسْحَاق , وَاسْتَدَلُّوا أَيْضًا بِعُمُومِ قَوْله تَعَالَى { وَحَرَّمَ عَلَيْكُمْ صَيْد الْبَرّ } وَلَكِنَّهُ يُعَارِض ذَلِكَ حَدِيث أَبِي قَتَادَةَ وَسَيَأْتِي. وَقَالَ الْكُوفِيُّونَ وَطَائِفَة مِنْ السَّلَف : إِنَّهُ يَجُوز لِلْمُحْرِمِ أَكْل لَحْم الصَّيْد مُطْلَقًا وَكِلَا الْمَذْهَبَيْنِ يَسْتَلْزِم إِطْرَاح بَعْض الْأَحَادِيث الصَّحِيحَة بِلَا مُوجِب , فَا…

"Zaid bin Arqam came and Ibn Abbas said to him, reminding him: "What did you tell me about the game meat that was given to the Messenger of Allah when he was in Ihram?" He said: "Yes, a man gave him a piece of game meat but he returned it and said: 'We cannot eat it, we are in Ihram.'"
