حَدَّثَنَا مَحْمُودُ بْنُ غَيْلاَنَ، حَدَّثَنَا أَبُو أَحْمَدَ الزُّبَيْرِيُّ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي قَيْسٍ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ، عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ، قَالَ لَعَنَ رَسُولُ اللَّهِ صلى الله عليه وسلم

الْمُحِلَّ وَالْمُحَلَّلَ لَهُ ‏

Abdullah bin Mas'ud narrated:

"The Messenger of Allah cursed the Muhill and the one the Muhallal was done for."

Al-Mubarakfuri — Tuhfat al-Ahwadhi

قَوْلُهُ : ( عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ لَعَنَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمُحِلَّ وَالْمُحَلَّلَ لَهُ ) قَالَ فِي سُبُلِ السَّلَامِ : الْحَدِيثُ دَلِيلٌ عَلَى تَحْرِيمِ التَّحْلِيلِ ; لِأَنَّهُ لَا يَكُونُ اللَّعْنُ إِلَّا عَلَى فَاعِلِ الْمُحَرَّمِ وَكُلُّ مُحَرَّمٍ مَنْهِيٌّ عَنْهُ وَالنَّهْيُ يَقْتَضِي فَسَادَ الْعَقْدِ وَاللَّعْنَ وَإِنْ كَانَ ذَلِكَ لِلْفَاعِلِ لَكِنَّهُ عُلِّقَ بِوَصْفٍ يَصِحُّ أَنْ يَكُونَ عِلَّةَ الْحُكْمِ وَذَكَرُوا لِلتَّحْلِيلِ صُوَرًا مِنْهَا أَنْ يَقُولَ لَهُ فِي الْعَقْدِ : إِذَا أَحْلَلْتهَا فَلَا نِكَاحَ وَهَذَا مِثْلُ نِكَاحِ الْمُتْعَةِ لِأَجْلِ التَّوْقِيتِ. وَمِنْهَا أَنْ يَقُولَ فِي الْعَقْدِ : إِذَا أَحْلَلْتهَا ط…

that the Messenger of said: 'Shall I not tell you of a borrowed billy goat.” They said: “Yes, O Messenger of!” He said: “He is Muhallil. May curse the Muhallil and the Muhallal lahu.”

"‏ أَلاَ أُخْبِرُكُمْ بِالتَّيْسِ الْمُسْتَعَارِ ‏"‏ ‏.‏ قَالُوا بَلَى يَا رَسُولَ اللَّهِ قَالَ ‏"‏ هُوَ الْمُحَلِّلُ لَعَنَ اللَّهُ الْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ ‏"

May Allah curse the Muhallil (a man who marries an irrevocably divorced woman for the sole purpose of making her lawful for her ex-husband to remarry) and the Muhallal lahu (the ex-husband of the woman who was irrevocably divorced, seeking to remarry her through an unlawful marriage)

‘Ali (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "May Allah curse the Muhallil and the Muhallal lahu."

لَعَنَ اللَّهُ الْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ ‏"
