أَخْبَرَنِي مُحَمَّدُ بْنُ وَهْبٍ، قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ حَدَّثَنِي أَبُو عَبْدِ الرَّحِيمِ، قَالَ حَدَّثَنِي زَيْدٌ، عَنْ أَبِي الزُّبَيْرِ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ ‏

"‏ لاَ تُرْقِبُوا أَمْوَالَكُمْ فَمَنْ أَرْقَبَ شَيْئًا فَهُوَ لِمَنْ أُرْقِبَهُ ‏"

Zaid narrated from Abu Az-Zubair, from Tawus, from Ibn 'Abbas that the Messenger of Allah said:

"Do not give away your property on the basis of Ruqba, for whoever gives a gift on that basis, it belongs to the one to whom he gave it."

Al-Sindi — Hashiyat al-Sindi on Sunan al-Nasa'i

قَوْله ( لَا تُرْقِبُوا ) بِضَمِّ التَّاء وَسُكُون الرَّاء وَكَسْر الْقَاف أَيْ لَا تَجْعَلُوهَا رُقْبَى فَهَذَا نَهْيٌ لَكِنْ عَلَّلَهُ بِقَوْلِهِ ( فَمَنْ أَرْقَبَ شَيْئًا ) عَلَى بِنَاء الْفَاعِل ( لِمَنْ أَرْقَبَهُ ) عَلَى بِنَاء الْمَفْعُول أَيْ فَلَا تُضَيِّعُوا أَمْوَالَكُمْ وَلَا تُخْرِجُوهَا مِنْ أَمْلَاكِكُمْ بِالرُّقْبَى فَالنَّهْيُ بِمَعْنَى أَنَّهُ لَا يَلِيقُ بِالْمَصْلَحَةِ وَإِنْ فَعَلْتُمْ يَكُونُ صَحِيحًا وَقِيلَ النَّهْيُ قَبْل التَّجْوِيزِ فَهُوَ مَنْسُوخ بِأَدِلَّةِ الْجَوَاز وَاَللَّه تَعَالَى أَعْلَم.…

"Do not give property "to go to the survivor" and do not give "life-tenancy", for if anyone is given either, the property goes to his heirs."

He reported the Prophet as saying, “Both life-tenancy and giving property which goes to the survivor are a gift which belongs to those who receive it." Ahmad, Tirmidhi and Abu Dawud transmitted it.

Authentic Sunan Ibn Majah 2380

“I heard the Messenger of Allah (ﷺ) say: 'Whoever gives a lifelong grant to a man, it belongs to him (the recipient) and to his heirs. His (the giver's) words put an end to his right to it, and it belongs to the one to whom it was given for life and to his heirs.”

"‏ مَنْ أَعْمَرَ رَجُلاً عُمْرَى لَهُ وَلِعَقِبِهِ فَقَدْ قَطَعَ قَوْلُهُ حَقَّهُ فِيهَا فَهِيَ لِمَنْ أُعْمِرَ وَلِعَقِبِهِ ‏"
