حَدَّثَنِي مُحَمَّدُ بْنُ مِنْهَالٍ الضَّرِيرُ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا سُفْيَانُ الثَّوْرِيُّ، عَنْ أَبِي حَصِينٍ، عَنْ عُمَيْرِ بْنِ سَعِيدٍ، عَنْ عَلِيٍّ، قَالَ مَا

كُنْتُ أُقِيمُ عَلَى أَحَدٍ حَدًّا فَيَمُوتَ فِيهِ فَأَجِدَ مِنْهُ فِي نَفْسِي إِلاَّ صَاحِبَ الْخَمْرِ لأَنَّهُ إِنْ مَاتَ وَدَيْتُهُ لأَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمْ يَسُنَّهُ ‏.‏

Ali reported:

If I impose Hadd on anyone, and he (in course of punish ment) dies, I would not mind except in case of a drunkard. If he dies. I would pay indemnity for him because the Messenger of Allah (ﷺ) has laid down no rule for it.

Reported by Muslim (No. 1707b, 1707c), Al-Bukhari (No. 6778) and Ahmad (No. 1030).

قَوْله : ( عَنْ أَبِي حَصِين عَنْ عُمَيْر بْن سَعِيد عَنْ عَلِيّ - رَضِيَ اللَّه عَنْهُ - قَالَ : مَا كُنْت أُقِيم عَلَى أَحَد حَدًّا فَيَمُوت فَأَجِد مِنْهُ إِلَّا صَاحِب الْخَمْر , لِأَنَّهُ إِنْ مَاتَ وَدَيْته ; لِأَنَّ رَسُول اللَّه صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ لَمْ يَسُنّهُ ) أَمَّا أَبُو حَصِين هَذَا فَهُوَ بِحَاءِ مَفْتُوحَة وَصَاد مَكْسُورَة , وَاسْمه : عُثْمَان بْن عَاصِم الْأَسَدِيُّ الْكُوفِيّ , وَأَمَّا عُمَيْر بْن سَعِيد فَهَكَذَا هُوَ فِي جَمِيع نُسَخ مُسْلِم عُمَيْر بْن سَعِيد بِالْيَاءِ فِي ( عُمَيْر ) وَفِي ( سَعِيد ) , هَكَذَا هُوَ فِي صَحِيح الْبُخَارِيّ وَجَمِيع كُتُب الْحَدِيث وَالْأَسْمَاء , وَلَا خِلَاف فِيهِ , وَوَقَعَ فِي الْجَمْع بَيْن الصَّحِيحَيْنِ ( عُمَيْر ب…
