Chapter: It is invalid to sell goods before taking possession of them

Authentic hadith of Sahih Muslim Muttafaq ‘alayh (Bukhari and Muslim) Sahih Muslim 1527d

Narrator:Abdullāh ibn ‘Umar

وَحَدَّثَنِي حَرْمَلَةُ بْنُ يَحْيَى، حَدَّثَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللَّهِ، أَنَّ أَبَاهُ، قَالَ قَدْ

رَأَيْتُ النَّاسَ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم إِذَا ابْتَاعُوا الطَّعَامَ جِزَافًا يُضْرَبُونَ فِي أَنْ يَبِيعُوهُ فِي مَكَانِهِمْ وَذَلِكَ حَتَّى يُئْوُوهُ إِلَى رِحَالِهِمْ ‏

Salim b. 'Abdullah (Allah be pleased with them) reported his father havingsaid this:

I saw people being beaten during the lifetime of Allah's Messenger (ﷺ) in case they bought the foodgrain in bulk, and then sold them at that spot before taking it to their places. This hadith is narrated on the authority of 'Ubaidullah b. Abdullah b. 'Umar through another chain of transmitters (and the words are):" His father (Ibn 'Umar) used to buy foodgrains in bulk and then carried them to his people."

Reported by Muslim (No. 1527d, 1527c), Al-Bukhari (No. 2131, 2137, 6852), An-Nasa’i (No. 4608) and Ahmad (No. 4288, 4901).

رَأَيْتُ الَّذِينَ يَشْتَرُونَ الطَّعَامَ مُجَازَفَةً يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنْ يَبِيعُوهُ حَتَّى يُئْوُوهُ إِلَى رِحَالِهِمْ‏.‏

I saw the people buy foodstuff randomly (i.e. blindly without measuring it) in the lifetime of Allah's Apostle and they were punished (by beating), if they tried to sell it before carrying it to their own houses.

لَقَدْ رَأَيْتُ النَّاسَ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم يَبْتَاعُونَ جِزَافًا ـ يَعْنِي الطَّعَامَ ـ يُضْرَبُونَ أَنْ يَبِيعُوهُ فِي مَكَانِهِمْ حَتَّى يُؤْوُوهُ إِلَى رِحَالِهِمْ‏.‏

Those people who used to buy foodstuff at random (without weighing or measuring it) were beaten in the lifetime of Allah's Messenger (ﷺ) if they sold it at the very place where they had bought it, till they carried it to their dwelling places.

كَانُوا يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم إِذَا اشْتَرَوْا طَعَامًا جِزَافًا أَنْ يَبِيعُوهُ فِي مَكَانِهِمْ حَتَّى يُئْوُوهُ إِلَى رِحَالِهِمْ‏.‏

Ibn 'Umar (Allah be pleased with them) reported that they were beaten during the lifetime of Allah's Messenger (ﷺ) if they had bought foodgrains in bulk and then sold them in the spot without shifting them (to some other place).

إِذَا اشْتَرَوْا طَعَامًا جِزَافًا أَنْ يَبِيعُوهُ فِي مَكَانِهِ حَتَّى يُحَوِّلُوهُ ‏.‏

"I saw people being beaten (in punishment) at the time of the Messenger of Allah for buying food unmeasured and selling it before bringing it to their own camp."

رَأَيْتُ النَّاسَ يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم إِذَا اشْتَرَوُا الطَّعَامَ جُزَافًا أَنْ يَبِيعُوهُ حَتَّى يُئْوُوهُ إِلَى رِحَالِهِمْ ‏.‏

Ibn ‘Umar said they used to buy grain in the upper part of the market and sell it in the same spot, but God’s Messenger forbade them to sell it there before removing it. Abu Dawud transmitted it. I have not found it in the two Sahihs.

During the time of Messenger of Allah (ﷺ) we used to buy grain, and he sent a man to us who ordered us to move it from the spot where we had bought it to some other place, before we sold it without weighing or measuring it.
