Chapter: Prohibition of relieving oneself in the middle of the road

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا عَمْرُو بْنُ أَبِي سَلَمَةَ، عَنْ زُهَيْرٍ، قَالَ قَالَ سَالِمٌ سَمِعْتُ الْحَسَنَ، يَقُولُ حَدَّثَنَا جَابِرُ بْنُ عَبْدِ اللَّهِ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏

"‏ إِيَّاكُمْ وَالتَّعْرِيسَ عَلَى جَوَادِّ الطَّرِيقِ وَالصَّلاَةَ عَلَيْهَا فَإِنَّهَا مَأْوَى الْحَيَّاتِ وَالسِّبَاعِ وَقَضَاءَ الْحَاجَةِ عَلَيْهَا فَإِنَّهَا مِنَ الْمَلاَعِنِ ‏"

It was narrated that Jabir bin 'Abdullah said:

"The Messenger of Allah said: 'Beware of stopping to rest and praying in the middle of the road, for it is the refuge of snakes and carnivorous animals, and beware of relieving yourselves in the middle of the road, for this is an act that provokes curses.'"

Reported by Ibn Majah (No. 329) and Ahmad (No. 13759).

Al-Sindi — Hashiyat al-Sindi on Sunan Ibn Majah

قَوْله ( وَالتَّعْرِيس ) أَيْ عِنْد نُزُول الْمُسَافِر آخِر اللَّيْل لِلنَّوْمِ وَالِاسْتِرَاحَة قَوْله ( عَلَى جَوَادّ الطَّرِيق ) أَيْ بِتَشْدِيدِ الدَّال جَمْع جَادَّة وَهِيَ مُعْظَم الطَّرِيق قَوْله ( وَالصَّلَاة ) عَطْف عَلَى التَّعْرِيس فَإِنَّهَا أَيْ جواد الطَّرِيق مَأْوَى الْحَيَّات أَيْ فِي اللَّيْل وَقَضَاء الْحَاجَة عَطْف عَلَى التَّعْرِيس فَإِنَّهَا الْمَلَاعِن أَيْ الْأَمْكِنَة الْجَالِبَة لِلَّعْنِ إِلَى مَنْ يَطَؤُهَا بِسَبَبِ كَثْرَة حَاجَة النَّاس إِلَيْهَا وَفِي الزَّوَائِد إِسْنَاده ضَعِيف فَإِنَّ سَالِمًا هُوَ عَبْد اللَّه الْخَيَّاط الْبَصْرِيّ ضَعَّفَهُ اِبْن مَعِين وَالنَّسَائِيُّ وَأَبُو حَاتِم وَابْن حِبَّان وَالدَّارَقُطْنِيّ.…
