Chapter: The Legal Punishment for the Thief

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا أَبُو هِشَامٍ الْمَخْزُومِيُّ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا أَبُو وَاقِدٍ، عَنْ عَامِرِ بْنِ سَعْدٍ، عَنْ أَبِيهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏

"‏ تُقْطَعُ يَدُ السَّارِقِ فِي ثَمَنِ الْمِجَنِّ ‏"

It was narrated from Amir bin Sa'd, from this father, that the Prophet (ﷺ) said:

“The hand of the thief is to be cut off for the price of a shield.

قَوْله ( فِي ثَمَن الْمِجَنّ ) الْمُرَاد بِالثَّمَنِ الْقِيمَة إِذْ الشَّيْء يُحَدُّ وَيُعْرَفُ بِالْقِيَمِ لَا بِالْأَثْمَانِ ثُمَّ الْمُرَاد مِجَنّ مُعَيَّن وَهُوَ مَا قِيمَته رُبْع دِينَار وَالْمِجَنّ عِنْدهمْ غَالِبًا مَا كَانَ أَقَلَّ مِنْ رُبْع دِينَار وَإِلَّا فَالْمِجَنّ مُخْتَلِف الْقِيمَة فَلَا يَصْلُحُ لِلضَّبْطِ وَفِي الزَّوَائِد فِي إِسْنَاده وَاقِد وَهُوَ ضَعِيف ضَعَّفَهُ غَيْر وَاحِد وَأَصْل الْحَدِيث فِي الصَّحِيحَيْنِ وَغَيْرهمَا مِنْ حَدِيث عَائِشَة وَأَبِي هُرَيْرَة وَابْن عُمَر رَضِيَ اللَّه عَنْهُمْ وَاَللَّه سُبْحَانه وَتَعَالَى أَعْلَم…

Malik related to me from Nafi from Abdullah ibn Umar that the Messenger of Allah, may Allah bless him and grant him peace, cut off the hand of a man who stole a shield whose price was three dirhams.

A thief’s hand should be cut off for a quarter of a dinar and upwards. Ahmed b. Salih said: The amputation (of a thief’s hand) is for a quarter of a dinar and upwards.

'A'isha reported that during the lifetime of Allah's Messenger (ﷺ) the hand of the thief was not cut off for less than the price of a shield, iron coat or armour and both of them are valuable.

لَمْ تُقْطَعْ يَدُ سَارِقٍ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي أَقَلَّ مِنْ ثَمَنِ الْمِجَنِّ حَجَفَةٍ أَوْ تُرْسٍ وَكِلاَهُمَا ذُو ثَمَنٍ ‏.‏

The hand of a thief was not cut off during the lifetime of the Prophet (ﷺ) except for stealing something equal to a shield in value. A similar hadith is narrated from `Aisha through another chain.
