Narrator:Abu Hurayrah

حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، حَدَّثَنِي اللَّيْثُ، عَنْ عُقَيْلٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، وَسَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ أَتَى رَجُلٌ رَسُولَ اللَّهِ صلى الله عليه وسلم وَهْوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ‏.‏ فَأَعْرَضَ عَنْهُ‏.‏ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعًا قَالَ ‏"‏

أَبِكَ جُنُونٌ ‏"‏‏.‏ قَالَ لاَ‏.‏ قَالَ ‏"‏ اذْهَبُوا بِهِ فَارْجُمُوهُ ‏"

Narrated Abu Huraira:

A man came to Allah's Messenger (ﷺ) while he was in the mosque, and called him, saying, "O Allah's Apostle! I have committed illegal sexual intercourse." The Prophet (ﷺ) turned his face to the other side, but when the man gave four witnesses against himself, the Prophet (ﷺ) said to him, "Are you mad?" The man said, "No." So the Prophet (ﷺ) said (to his companions), "Take him away and stone him to death. "

قَوْله ( رَوَاهُ يُونُس وَمَعْمَر وَابْن جُرَيْجٍ عَنْ الزُّهْرِيّ عَنْ أَبِي سَلَمَة عَنْ جَابِر ) يُرِيد أَنَّهُمْ خَالَفُوا عُقَيْلًا فِي الصَّحَابِيّ , فَإِنَّهُ جَعَلَ أَصْل الْحَدِيث مِنْ رِوَايَة أَبِي سَلَمَة عَنْ أَبِي هُرَيْرَة , وَقَوْل اِبْن شِهَاب " أَخْبَرَنِي مَنْ سَمِعَ جَابِر بْن عَبْد اللَّه : كُنْت فِيمَنْ رَجَمَهُ بِالْمُصَلَّى " وَهَؤُلَاءِ جَعَلُوا الْحَدِيث كُلّه عَنْ جَابِر , وَرِوَايَة مَعْمَر وَصَلَهَا الْمُؤَلِّف فِي الْحُدُود , وَكَذَلِكَ رِوَايَة يُونُس , وَأَمَّا رِوَايَة اِبْن جُرَيْجٍ فَوَصَلَهَا وَتَقَدَّمَتْ الْإِشَارَة إِلَيْهَا هُنَاكَ أَيْضًا حَيْثُ قَالَ عَقِبَ رِوَايَة مَعْمَر " لَمْ يَقُلْ يُونُس وَابْن جُرَيْجٍ فَصَلَّى عَلَيْهِ " وَتَقَدَّمَ شَرْحه م…

Jabir said that a man committed fornication with a woman and the Prophet gave command that he be given the appropriate beating, but on being told afterwards that the man was married he gave command that he should be stoned to death. Abu Dawud transmitted it.
