Narrator:Ā’ishah

حَدَّثَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ ذَكْوَانَ، عَنْ عَائِشَةَ ـ رضى الله عنها ـ قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

الْبِكْرُ تُسْتَأْذَنُ ‏"‏‏.‏ قُلْتُ إِنَّ الْبِكْرَ تَسْتَحْيِي قَالَ ‏"‏ إِذْنُهَا صُمَاتُهَا ‏"

Narrated `Aisha:

Allah's Messenger (ﷺ) said, "It is essential to have the consent of a virgin (for the marriage). I said, "A virgin feels shy." The Prophet; said, "Her silence means her consent." Some people said, "If a man falls in love with an orphan slave girl or a virgin and she refuses (him) and then he makes a trick by bringing two false witnesses to testify that he has married her, and then she attains the age of puberty and agrees to marry him and the judge accepts the false witness and the husband knows that the witnesses were false ones, he may consummate his marriage."

قَوْله ( الْبِكْر تُسْتَأْذَن ) تَقَدَّمَ فِي الْإِكْرَاه مِنْ طَرِيق سُفْيَان عَنْ اِبْن جُرَيْج بِهَذَا الْإِسْنَاد " قُلْت يَا رَسُول اللَّه الْبِكْر تُسْتَأْمَر ؟ قَالَ : نَعَمْ ". قَوْله ( وَقَالَ بَعْض النَّاس إِنْ هَوِيَ ) بِكَسْرِ الْوَاو أَيْ أَحَبَّ ( إِنْسَان ) فِي رِوَايَة الْكُشْمِيهَنِيّ " رَجُل ". قَوْله ( جَارِيَة يَتِيمَة أَوْ بِكْرًا ) فِي رِوَايَة الْكُشْمِيهَنِيّ " ثَيِّبًا " وَوَقَعَ عِنْد اِبْن بَطَّال كَذَلِكَ , وَيُؤَيِّد الْأَوَّل قَوْلُهُ فِي بَقِيَّة الْكَلَام " فَأَدْرَكَتْ الْيَتِيمَة " فَظَاهِره أَنَّهَا كَانَتْ غَيْر بَالِغ , وَيَحْتَمِل أَنَّ قَوْله " جَاءَ بِشَاهِدَيْنِ " أَيْ يَشْهَدَانِ عَلَى أَنَّهَا مُدْرِكَة وَرَضِيَتْ. قَوْله ( فَقَبِلَ الْقَاضِي بِشَهَ…

Authentic Sunan Ibn Majah 1870

the Messenger of Allah said: “A widow has more right (to decide) concerning herself than her guardian, and a virgin should be consulted”. It was said: “O Messenger of Allah, a virgin may be too shy to speak.” He said: “Her consent is her silence.”

I asked the Prophet, "O Allah's Messenger (ﷺ)! Should the women be asked for their consent to their marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent."

يُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ قَالَ ‏"‏ نَعَمْ ‏"‏‏.‏ قُلْتُ فَإِنَّ الْبِكْرَ تُسْتَأْمَرُ فَتَسْتَحِي فَتَسْكُتُ‏.‏ قَالَ ‏"‏ سُكَاتُهَا إِذْنُهَا ‏"
