حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ أَبِي عَمْرٍو ـ هُوَ ذَكْوَانُ ـ عَنْ عَائِشَةَ ـ رضى الله عنها ـ قَالَتْ قُلْتُ يَا رَسُولَ اللَّهِ

يُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ قَالَ ‏"‏ نَعَمْ ‏"‏‏.‏ قُلْتُ فَإِنَّ الْبِكْرَ تُسْتَأْمَرُ فَتَسْتَحِي فَتَسْكُتُ‏.‏ قَالَ ‏"‏ سُكَاتُهَا إِذْنُهَا ‏"

Narrated `Aisha:

I asked the Prophet, "O Allah's Messenger (ﷺ)! Should the women be asked for their consent to their marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent."

قَوْله ( حَدَّثَنَا مُحَمَّد بْن يُوسُف حَدَّثَنَا سُفْيَان ) الظَّاهِر أَنَّهُ الْفِرْيَابِيّ وَشَيْخه الثَّوْرِيّ , وَيَحْتَمِل أَنْ يَكُون الْبِيكَنْدِيّ وَشَيْخه اِبْن عُيَيْنَةَ فَإِنَّ كُلًّا مِنْ السُّفْيَانَيْنِ مَعْرُوف بِالرِّوَايَةِ عَنْ اِبْن جُرَيْجٍ , لَكِنَّ هَذَا الْحَدِيث إِنَّمَا هُوَ عَنْ الْفِرْيَابِيّ كَمَا جَزَمَ بِهِ أَبُو نُعَيْم , وَالْفِرْيَابِيّ إِذَا أَطْلَقَ سُفْيَان أَرَادَ الثَّوْرِيّ وَإِذَا أَرَادَ اِبْن عُيَيْنَةَ نَسَبَهُ. قَوْله ( ذَكْوَان ) يَعْنِي مَوْلَى عَائِشَةَ. قَوْله ( قُلْت : يَا رَسُول اللَّه يُسْتَأْمَر النِّسَاء فِي أَبْضَاعهنَّ ؟ قَالَ : نَعَمْ ) فِي رِوَايَة حَجَّاج بْن مُحَمَّد وَأَبُو عَاصِم عَنْ اِبْن جَرِير " سَمِعْت اِبْن أَبِي مُلَيْكَة…

the Messenger of Allah said: “A widow has more right (to decide) concerning herself than her guardian, and a virgin should be consulted”. It was said: “O Messenger of Allah, a virgin may be too shy to speak.” He said: “Her consent is her silence.”
