Narrator:Abdullāh ibn ‘Umar

وَقَالَ لِي ابْنُ بَشَّارٍ حَدَّثَنَا يَحْيَى، عَنْ عُبَيْدِ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّ غُلاَمًا، قُتِلَ غِيلَةً فَقَالَ عُمَرُ لَوِ اشْتَرَكَ فِيهَا أَهْلُ صَنْعَاءَ لَقَتَلْتُهُمْ‏.‏ وَقَالَ مُغِيرَةُ بْنُ حَكِيمٍ عَنْ أَبِيهِ إِنَّ أَرْبَعَةً قَتَلُوا صَبِيًّا فَقَالَ عُمَرُ مِثْلَهُ‏.‏ وَأَقَادَ أَبُو بَكْرٍ وَابْنُ الزُّبَيْرِ وَعَلِيٌّ وَسُوَيْدُ بْنُ مُقَرِّنٍ مِنْ لَطْمَةٍ‏.‏ وَأَقَادَ عُمَرُ مِنْ ضَرْبَةٍ بِالدِّرَّةِ‏.‏ وَأَقَادَ عَلِيٌّ مِنْ ثَلاَثَةِ أَسْوَاطٍ‏.‏ وَاقْتَصَّ شُرَيْحٌ مِنْ سَوْطٍ وَخُمُوشٍ‏.‏

Ibn ‘Umar (may Allah be pleased with him) reported that a boy was murdered, so ‘Umar said: "If all the people of Sanaa took part in murder I would kill them all."

Explanation

During the time of ‘Umar (may Allah be pleased with him) a group of five or seven people killed a boy inadvertently. ‘Umar (may Allah be pleased with him) ordered that they should all be killed. He did so, confirming the obligation of killing a group of people if they have collaborated in the killing of one person. He said that if all the people of Sanaa had killed one person, he would order them all to be killed. The Companions and jurists have agreed on this ruling, in order that refraining from effectuating retribution would not lead to more collaboration in blood-shedding. ‘Umar (may Allah be pleased with him) mentioned Sanaa in particular, either because the boy’s killers were from there or because the Arabs used to mention the name of Sanaa when referring to huge numbers of inhabitants.

اشترك جماعة من الناس -خمسة أو سبعة- على عهد عمر رضي الله عنه فقتلوا غلامًا على حين غفلةٍ منه، فأمر عمر رضي الله عنه بقتلهم جميعا، وقال -مؤكدا- وجوب قتل الجماعة بالواحد إذا اجتمعوا وتساعدوا في القتل: لو اشترك فيها أهل صنعاء جميعًا لقتلتهم به، وقد اتَّفق الصحابة، وعامة الفقهاء على هذا الحكم؛ لئلا يكون عدم القصاص سببًا إلى التعاون على سفك الدماء.

وتخصيص صنعاء بالذكر في هذا الأثر؛ لأنَّ هؤلاء الرجال القتلة كانوا منها، أو أنَّه مثل عند العرب يضرب لكثرة السكَّان.

  • أن الجماعة تقتل بالواحد، إذا كان فعل كل واحد منهم صالحًا للقتل به لو انفرد.
  • الحكم بقتل الجماعة بالواحد سد للذرائع الموصلة إلى الفساد؛ وذلك أن عدم القصاص -في هذه الحال- ذريعة إلى التعاون على سفك الدماء.
  • تشديد الشريعة في مسألة الدماء.
  • أنَّ القاتل قَتْلَ غيلة يقتل حدًّا، لا قصاصًا، ولا يصح فيه العفو من أحد, وعليه فتوى هيئة كبار العلماء في المملكة العربية السعودية.
