حَدَّثَنِي إِسْحَاقُ، أَخْبَرَنَا حَبَّانُ، حَدَّثَنَا هَمَّامٌ، حَدَّثَنَا قَتَادَةُ، حَدَّثَنَا أَنَسُ بْنُ مَالِكٍ، أَنَّ

يَهُودِيًّا، رَضَّ رَأْسَ جَارِيَةٍ بَيْنَ حَجَرَيْنِ، فَقِيلَ لَهَا مَنْ فَعَلَ بِكِ هَذَا أَفُلاَنٌ أَفُلاَنٌ حَتَّى سُمِّيَ الْيَهُودِيُّ فَأَوْمَأَتْ بِرَأْسِهَا، فَجِيءَ بِالْيَهُودِيِّ فَاعْتَرَفَ، فَأَمَرَ بِهِ النَّبِيُّ صلى الله عليه وسلم فَرُضَّ رَأْسُهُ بِالْحِجَارَةِ‏.‏

Narrated Anas bin Malik:

A Jew crushed the head of a girl between two stones. It was said to her. "Who has done this to you, such-and-such person, such-and-such person?" When the name of the Jew was mentioned, she nodded with her head, agreeing. So the Jew was brought and he confessed. The Prophet (ﷺ) ordered that his head be crushed with the stones. (Hammam said, "with two stones.")

قَوْله ( فَجِيءَ بِالْيَهُودِيِّ فَاعْتَرَفَ ) فِي رِوَايَة هُدْبَة عَنْ هَمَّام " فَأُتِيَ بِهِ النَّبِيُّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ فَلَمْ يَزَلْ بِهِ حَتَّى أَقَرَّ " أَخْرَجَهُ الْإِسْمَاعِيلِيّ , وَفِي حَدِيث أَنَس فِي قِصَّة الْيَهُودِيّ حُجَّة لِلْجُمْهُورِ فِي أَنَّهُ لَا يُشْتَرَطُ فِي الْإِقْرَار بِالْقَتْلِ أَنْ يَتَكَرَّر , وَهُوَ مَأْخُوذ مِنْ إِطْلَاق قَوْله " فَأُخِذَ الْيَهُودِيُّ فَاعْتَرَفَ " فَإِنَّهُ لَمْ يَذْكُر فِيهِ عَدَدًا وَالْأَصْل عَدَمه , وَذَهَبَ الْكُوفِيُّونَ إِلَى اِشْتِرَاط تَكْرَار الْإِقْرَار بِالْقَتْلِ مَرَّتَيْنِ قِيَاسًا عَلَى اِشْتِرَاط تَكْرَار الْإِقْرَار بِالزِّنَا أَرْبَعًا تَبَعًا لِعَدَدِ الشُّهُود فِي الْمَوْضِعَيْنِ.…

Anas reported that a Jew killed a girl of the Ansar for her ornaments and then threw her in a well and smashed her head with a stone. He was caught and brought to the Messenger of Allah (ﷺ), and he commanded that he should be stoned to death. So he was stoned until he died.
