Chapter: A female slave, whose husband is a slave, has the option to keep him or leave him (when she is manumitted).

Narrator:Ibn ‘Abbās

حَدَّثَنَا عَبْدُ الأَعْلَى بْنُ حَمَّادٍ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا أَيُّوبُ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ ذَاكَ

مُغِيثٌ عَبْدُ بَنِي فُلاَنٍ ـ يَعْنِي زَوْجَ بَرِيرَةَ ـ كَأَنِّي أَنْظُرُ إِلَيْهِ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ، يَبْكِي عَلَيْهَا‏.‏

Narrated Ibn `Abbas:

That was Mughith, the slave of Bani so-and-so, i.e., Barira's husband as if I am now looking at him following her (Barira) along the streets of Medina.

قَوْله ( عَبْدًا لِبَنِي فُلَان ) عِنْد التِّرْمِذِيّ مِنْ طَرِيق سَعِيد بْن أَبِي عَرُوبَة عَنْ أَيُّوب " كَانَ عَبْدًا أَسْوَد لِبَنِيَّ الْمُغِيرَة " وَفِي رِوَايَة هُشَيْم عَنْ سَعِيد بْن مَنْصُور " وَكَانَ عَبْدًا لِآلِ الْمُغِيرَة مِنْ بَنِي مَخْزُوم " وَوَقَعَ فِي الْمَعْرِفَة لِابْنِ مَنْدَهْ مُغِيث مَوْلَى أَحْمَد بْن جَحْش , ثُمَّ سَاقَ الْحَدِيث مِنْ طَرِيق سَعِيد بْن أَبِي عَرُوبَة مِثْل مَا وَقَعَ فِي التِّرْمِذِيّ , لَكِنْ عِنْد أَبِي دَاوُدَ بِسَنَدٍ فِيهِ اِبْن إِسْحَاق " وَهِيَ عِنْد مُغِيث عَبْد لِآلِ أَبِي أَحْمَد " وَقَالَ اِبْن عَبْد الْبَرّ " مَوْلَى بَنِي مُطِيع " وَالْأَوَّل أَثْبَت لِصِحَّةِ إِسْنَاده وَيَبْعُدُ الْجَمْع لِأَنَّ بَنِي الْمُغِيرَة مِنْ آل مَخْزُوم فِي…
