Narrator:Al-Miswar ibn Makhrama

حَدَّثَنَا أَبُو الْوَلِيدِ، حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ، قَالَ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم يَقُولُ ‏"‏ إِنَّ بَنِي الْمُغِيرَةِ

اسْتَأْذَنُوا فِي أَنْ يَنْكِحَ عَلِيٌّ ابْنَتَهُمْ، فَلاَ آذَنُ ‏"

Narrated Al-Miswar bin Makhrama Az-Zuhri:

I heard the Prophet (ﷺ) saying, "Banu Al-Mughira have asked my leave to let `Ali marry their daughter, but I give no leave to this effect."

حَدِيث الْمِسْوَر فِي خِطْبَة عَلِيٍّ بِنْتَ أَبِي جَهْل قَدْ تَقَدَّمَتْ الْإِشَارَة إِلَيْهِ فِي النِّكَاح , وَاعْتَرَضَهُ اِبْن التِّين بِأَنَّهُ لَيْسَ فِيهِ دَلَالَة عَلَى مَا تَرْجَمَ بِهِ , وَنَقَلَ اِبْن بَطَّالٍ قَبْله عَنْ الْمُهَلَّب قَالَ : إِنَّمَا حَاوَلَ الْبُخَارِيّ بِإِيرَادِهِ أَنْ يَجْعَل قَوْل النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ " فَلَا آذَن " خُلْعًا وَلَا يَقْوَى ذَلِكَ لِأَنَّهُ قَالَ فِي الْخَبَر " إِلَّا أَنْ يُرِيد اِبْن أَبِي طَالِب أَنْ يُطَلِّق اِبْنَتِي " فَدَلَّ عَلَى الطَّلَاق , فَإِنْ أَرَادَ أَنْ يَسْتَدِلّ بِالطَّلَاقِ عَلَى الْخُلْع فَهُوَ ضَعِيف وَإِنَّمَا يُؤْخَذ مِنْهُ الْحُكْم بِقَطْعِ الذَّرَائِع. وَقَالَ اِبْن الْمُنَيِّرِفِي الْحَاشِيَة : يُم…
