Chapter: A woman should not marry a man already married to her paternal aunt

Authentic hadith of Sahih al-Bukhari Sahih al-Bukhari 5110

حَدَّثَنَا عَبْدَانُ، أَخْبَرَنَا عَبْدُ اللَّهِ، قَالَ أَخْبَرَنِي يُونُسُ، عَنِ الزُّهْرِيِّ، قَالَ حَدَّثَنِي قَبِيصَةُ بْنُ ذُؤَيْبٍ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ، يَقُولُ نَهَى النَّبِيُّ صلى الله عليه وسلم أَنْ

تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا وَالْمَرْأَةُ وَخَالَتُهَا‏.‏

Narrated Abu Huraira:

The Prophet (ﷺ) forbade that a woman should be married to a man along with her paternal aunt or with her maternal aunt (at the same time). Az-Zuhri (the sub-narrator) said: There is a similar order for the paternal aunt of the father of one's wife, for 'Urwa told me that `Aisha said, "What is unlawful because of blood relations, is also unlawful because of the corresponding foster suckling relations."

Ibn Hajar al-Asqalani — Fath al-Bari

قَوْله ( فَنُرَى ) بِضَمِّ النُّون أَيْ نَظُنّ , وَبِفَتْحِهَا أَيْ نَعْتَقِد. قَوْله ( خَالَة أَبِيهَا بِتِلْكَ الْمَنْزِلَة ) أَيْ مِنْ التَّحْرِيم. قَوْله ( لِأَنَّ عُرْوَة حَدَّثَنِي إِلَخْ ) فِي أَخْذ هَذَا الْحُكْمِ مِنْ هَذَا الْحَدِيث نَظَر , وَكَأَنَّهُ أَرَادَ إِلْحَاق مَا يُحَرِّم بِالصِّهْرِ بِمَا يُحَرِّم بِالنَّسَبِ كَمَا يُحَرِّم بِالرَّضَاعِ مَا يُحَرِّم بِالنَّسَبِ , وَلَمَّا كَانَتْ خَالَة الْأَب مِنْ الرَّضَاع لَا يَحِلّ نِكَاحهَا فَكَذَلِكَ خَالَة الْأَب لَا يُجْمَع بَيْنهَا وَبَيْن بِنْت اِبْن أَخِيهَا , وَقَدْ تَقَدَّمَ شَرْحُ حَدِيث عَائِشَة الْمَذْكُور. قَالَ النَّوَوِيّ : اِحْتَجَّ الْجُمْهُور بِهَذِهِ الْأَحَادِيث وَخَصُّوا بِهَا عُمُوم الْقُرْآن فِي قَوْله تَعَالَى…

Abu Hurairah said “The Apostle of Allah (ﷺ) forbade that a woman and her maternal aunt and a woman and her paternal aunt are joined in marriage (to the same man).”
