Narrator:Abdullāh ibn ‘Umar

حَدَّثَنَا أَحْمَدُ بْنُ مِقْدَامٍ، حَدَّثَنَا الْفُضَيْلُ بْنُ سُلَيْمَانَ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ، أَخْبَرَنِي نَافِعٌ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّهُ كَانَ يُفْتِي فِي الْعَبْدِ أَوِ الأَمَةِ يَكُونُ بَيْنَ شُرَكَاءَ، فَيُعْتِقُ أَحَدُهُمْ نَصِيبَهُ مِنْهُ، يَقُولُ

قَدْ وَجَبَ عَلَيْهِ عِتْقُهُ كُلِّهِ، إِذَا كَانَ لِلَّذِي أَعْتَقَ مِنَ الْمَالِ مَا يَبْلُغُ، يُقَوَّمُ مِنْ مَالِهِ قِيمَةَ الْعَدْلِ، وَيُدْفَعُ إِلَى الشُّرَكَاءِ أَنْصِبَاؤُهُمْ، وَيُخَلَّى سَبِيلُ الْمُعْتَقِ‏

Narrated Ibn `Umar:

That he used to give his verdict regarding the male or female slaves owned by more than one master, one of whom may manumit his share of the slave. Ibn `Umar used to say in such a case, "The manumitted should manumit the slave completely if he has sufficient money to pay the rest of the price of that slave (which is to be justly estimated) and the other shareholders are to take the price of their shares and the slave is freed (released from slavery)." Ibn `Umar narrated this verdict from the Prophet.

قَوْله : ( أَنَّهُ كَانَ يُفْتِي إِلَخْ ) كَأَنَّ الْبُخَارِيَّ أَوْرَدَ هَذِهِ الطَّرِيق يُشِيرُ بِهَا إِلَى أَنَّ اِبْن عُمَر رَاوِي الْحَدِيث أَفْتَى بِمَا يَقْتَضِيهِ ظَاهِره فِي حَقّ الْمُوسِر لِيَرُدّ بِذَلِكَ عَلَى مَنْ لَمْ يَقُلْ بِهِ , وَلَمْ يَتَفَرَّدْ مُوسَى بْن عُقْبَة عَنْ نَافِع بِهَذَا الْإِسْنَاد بَلْ وَافَقَهُ صَخْر بْن جُوَيْرِيَةَ عَنْ نَافِع , أَخْرَجَهُ أَبُو عَوَانَة وَالطَّحَاوِيّ وَالدَّارَقُطْنِيّ مِنْ طَرِيقه. قَوْله : ( وَرَوَاهُ اللَّيْث وَابْن أَبِي ذِئْب وَابْن إِسْحَاق وَجُوَيْرِيَةُ وَيَحْيَى بْن سَعِيد وَإِسْمَاعِيل بْن أُمَيَّة عَنْ نَافِع عَنْ اِبْن عُمَر عَنْ النَّبِيّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُخْتَصَرًا ) يَعْنِي وَلَمْ يَذْكُرُوا الْجُمْلَة ا…

Abu Huraira reported the Prophet as saying, “If anyone emancipates a share in a slave, he is to be completely emancipated if he has money; but if he has none, the slave will be required to work to pay for his freedom, but must not be overburdened.” (Bukhari and Muslim.)

Abul Malih told on his father's authority that when a man emancipated a share in a slave, and the matter was mentioned to the Prophet he said, “God has no partner,” and decided chat he should be emancipated. Abu Dawud transmitted it.

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

The Prophet (ﷺ) said, "If one manumits his share of a common slave (Abd), and he has money sufficient to free the remaining portion of the price of the slave (justly estimated), then he should free the slave completely by paying the rest of his price; otherwise the slave is freed partly. "
