Sahih al-Bukhari 2415

Chapter: If somebody sells a thing for a weak-minded person and pays him the price, and advised him to utilize it in a proper way and not to spoil it, and he spoils it, he can stop him from doing so, for the Prophet had forbidden the wasting of the property. The Prophet ordered the person who said that he had always been cheated in buying, to say, at the time of the deal, "No cheating!" The Prophet did not take his money (of the person who sold his slave, because he had not proved foolish).

Narrator:Jābir ibn ‘Abdullāh

حَدَّثَنَا عَاصِمُ بْنُ عَلِيٍّ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرٍ ـ رضى الله عنه ـ

أَنَّ رَجُلاً، أَعْتَقَ عَبْدًا لَهُ، لَيْسَ لَهُ مَالٌ غَيْرُهُ، فَرَدَّهُ النَّبِيُّ صلى الله عليه وسلم، فَابْتَاعَهُ مِنْهُ نُعَيْمُ بْنُ النَّحَّامِ‏.‏

Narrated Jabir:

A man manumitted a slave and he had no other property than that, so the Prophet (ﷺ) canceled the manumission (and sold the slave for him). Nu'aim bin Al-Nahham bought the slave from him.

Explanation in Arabic

رتَّبَ الإسلامُ أوْلوياتِ النَّاسِ في النَّفقةِ والصَّدقةِ؛ حتَّى تَسيرَ الحياةُ بصُورةٍ طَيِّبةٍ، ولا يُظْلَمَ فيها أحدٌ، ولا تَضْطرِبَ الحُقوقُ والواجباتُ عندَ النَّاسِ.

وفي هذا الحديثِ يُخْبِرُ جابرُ بنُ عبدِ اللهِ رَضِيَ اللهُ عنهما أنَّ رَجُلًا مِنَ الأنْصارِ -وفي روايةٍ عند مُسلمٍ: «أعتَقَ رجُلٌ مِن بَني عُذْرةَ»، وهو حَيٌّ مِن قَبيلةِ قُضاعةَ- «عبْدًا له عن دُبُرٍ»، أي: قرَّرَ هذا الرَّجلُ أنَّه بعْدَ أنْ يَموتَ يُصْبِحُ مَملوكُه حُرًّا، ولَمْ يَكُنْ له مالٌ غَيْرُ هذا العَبدِ، وهذا كنايةٌ عن احتياجِه للمالِ، فبلَغَ ذلك رَسولَ اللهِ صلَّى اللهُ عليه وسلَّم، فلم يوافِقْه على فِعْلِه ذلك، ثم سأل النَّبيُّ صلَّى اللهُ عليه وسلَّم أصحابَه: «مَن يَشتريه مِنِّي؟» فأراد النَّبيُّ صلَّى اللهُ عليه وسلَّم بيْعَه للرَّجلِ؛ لكَونِه فَقيرًا مُحتاجًا للمالِ؛ فبَيْعُه والانتفاعُ بِمالِه أوْلى مِن عِتْقِه، فاشتراهُ نُعيمُ بنُ عبدِ اللهِ بن النحامِ العَدويُّ بثَمانِمِائةِ دِرْهمٍ، فجاء بها لرَسولِ اللهِ صلَّى اللهُ عليه وسلَّم، فأعطاها النَّبيُّ صلَّى اللهُ عليه وسلَّم للرَّجلِ.

قال عَمرُو بنُ دِينارٍ -راوي الحديثِ-: إنَّه سمع جابِرَ بنَ عبدِ اللهِ رَضِيَ اللهُ عنهما يُخبِرُ أنَّ هذا العبدَ كان عَبْدًا قِبْطِيًّا، أي: من مِصْرَ، «ماتَ عامَ أوَّلَ» أي: في الزَّمَنِ الأوَّلِ، أي: قبل عامِهم الذي حَدَّث فيه جابِرٌ بالحديثِ.

A man decided that a slave of his would be manumitted after his death and later on he was in need of money, so the Prophet (ﷺ) took the slave and said, "Who will buy this slave from me?" Nu'aim bin `Abdullah bought him for such and such price and the Prophet (ﷺ) gave him the slave.

رَجُلاً أَعْتَقَ غُلاَمًا لَهُ عَنْ دُبُرٍ، فَاحْتَاجَ فَأَخَذَهُ النَّبِيُّ صلى الله عليه وسلم فَقَالَ ‏"‏ مَنْ يَشْتَرِيهِ مِنِّي ‏"‏ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ بِكَذَا وَكَذَا، فَدَفَعَهُ إِلَيْهِ‏.‏

A man amongst us declared that his slave would be freed after his death. The Prophet (ﷺ) called for that slave and sold him. The slave died the same year.
