حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ الْهُذَلِيُّ، حَدَّثَنَا ابْنُ عُلَيَّةَ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، عَنْ قَيْسِ بْنِ عُبَادٍ، قَالَ قُلْتُ لِعَلِيٍّ رضى الله عنه

أَخْبِرْنَا عَنْ مَسِيرِكَ هَذَا أَعَهْدٌ عَهِدَهُ إِلَيْكَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَمْ رَأْىٌ رَأَيْتَهُ فَقَالَ مَا عَهِدَ إِلَىَّ رَسُولُ اللَّهِ صلى الله عليه وسلم بِشَىْءٍ وَلَكِنَّهُ رَأْىٌ رَأَيْتُهُ ‏.‏

Qais b. ‘Abbad said :

I said to ‘All (Allah be pleased with him) : Tell me about this march of yours. Is this an order that the Messenger of Allah (May peace be upon him) had given you, or is this your opinion that you have? He said: The Messenger of Allah (May peace be upon him) did not give me any order; but this is an opinion that I have.

Explanation in Arabic

روى قيس بن عباد أنه سأل عليًّا رضي الله عنه عن مسيره في بعض الأحوال التي التقى فيها مع من يقابله من المسلمين، وذلك في الجمل أو صفين، فقيل: هل مسيرك هذا شيء عَهِد إليك به رسول الله صلى الله عليه وسلم أي أوصاك وأمرك به أو أنه رأي رأيتَه بالاجتهاد؟ لأن الصحابة أدركوا ما لم يُدركه التابعون من العهد النبوي، فأخبر علي بأنه لم يعهد إليه الرسول صلى الله عليه وسلم بشيء من ذلك، وإنما هو رأي رآه، واجتهاد حصل منه رضي الله تعالى عنه وأرضاه.

  • حرص السلف على معرفة ما ورد عن النبي صلى الله عليه وسلم.
  • جواز الاجتهاد في القتال.
  • العمل بالرأي والاجتهاد إن لم يوجد نص صريح من الكتاب والسنة.

( قُلْت لِعَلِيٍّ ) : أَيْ اِبْن أَبِي طَالِب رَضِيَ اللَّه عَنْهُ ( عَنْ مَسِيرك هَذَا ) : أَيْ إِلَى بِلَاد الْعِرَاق لِقِتَالِ مُعَاوِيَة أَوْ مَسِيرك إِلَى الْبَصْرَة لِقِتَالِ الزُّبَيْر رَضِيَ اللَّه عَنْهُمَا , وَبَيَانه كَمَا قَالَ اِبْن سَعْد أَنَّ عَلِيًّا رَضِيَ اللَّه عَنْهُ بُويِعَ بِالْخِلَافَةِ الْغَد مِنْ قَتْل عُثْمَان بِالْمَدِينَةِ فَبَايَعَهُ جَمِيع مَنْ كَانَ بِهَا مِنْ الصَّحَابَة , وَيُقَال إِنَّ طَلْحَة وَالزُّبَيْر رَضِيَ اللَّه عَنْهُمَا بَايَعَا كَارِهَيْنِ غَيْر طَائِعَيْنِ ثُمَّ خَرَجَا إِلَى مَكَّة وَعَائِشَة رَضِيَ اللَّه عَنْهَا بِهَا فَأَخَذَاهَا وَخَرَجَا بِهَا إِلَى الْبَصْرَة , فَبَلَغَ ذَلِكَ عَلِيًّا فَخَرَجَ إِلَى الْعِرَاق فَلَقِيَ بِالْبَصْرَةِ طَلْحَ…
