Chapter: One who drinks khamr repeatedly

Narrator:Abdullāh ibn ‘Umar

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، عَنْ حُمَيْدِ بْنِ يَزِيدَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ بِهَذَا الْمَعْنَى قَالَ وَأَحْسِبُهُ قَالَ فِي الْخَامِسَةِ ‏"‏ إِنْ شَرِبَهَا فَاقْتُلُوهُ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ وَكَذَا فِي حَدِيثِ أَبِي غُطَيْفٍ فِي الْخَامِسَةِ ‏.‏

The tradition mentioned above has also been transmitted by Ibn ‘Umar through a different chain of narrators to the same effect. This version has :

I think he said for the fifth time: If he drinks it, kill him.

Abu Dawud said: And similarly the word “a fifth time” occurs in the tradition of Abu Ghutaif.

Al-Azimabadi — Awn al-Ma'bud

( ذَكْوَان ) : بَدَل مِنْ أَبِي صَالِح وَهُوَ السَّمَّان الزَّيَّات الْمَدَنِيّ ثِقَة ثَبْت , وَكَانَ يَجْلِب الزَّيْت إِلَى الْكُوفَة قَالَهُ الْحَافِظ ( ثُمَّ إِنْ شَرِبُوا فَاقْتُلُوهُمْ ) . قَالَ التِّرْمِذِيّ فِي كِتَاب الْعِلَل : أَجْمَعَ النَّاس عَلَى تَرْكه أَيْ أَنَّهُ مَنْسُوخ وَقِيلَ مُؤَوَّل بِالضَّرْبِ الشَّدِيد. وَقَالَ الزَّيْلَعِيُّ قَالَ اِبْن حِبَّان فِي صَحِيحه : مَعْنَاهُ إِذَا اِسْتَحَلَّ وَلَمْ يَقْبَل التَّحْرِيم اِنْتَهَى. وَبَسَطَ السُّيُوطِيُّ الْكَلَام فِي حَاشِيَة التِّرْمِذِيّ وَقَصَدَ بِهِ إِثْبَات أَنَّهُ يَنْبَغِي الْعَمَل بِهِ كَذَا قَالَ الْعَلَّامَة السِّنْدِيُّ فِي حَاشِيَة اِبْن مَاجَهْ. قُلْت : قَالَ السُّيُوطِيُّ فِيهَا بَعْد الْإِشَارَة إِلَى عِدَّة أَ…

The Messenger of Allah [SAW] said: "If he becomes drunk, whip him; then if he becomes drunk, whip him; then if he becomes drunk, whip him." Then he said concerning the fourth time, "Strike his neck (i.e., kill him)."
