حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ، أَخْبَرَنَا مُحَمَّدُ بْنُ بَكْرٍ، حَدَّثَنَا ابْنُ جُرَيْجٍ، قَالَ قَالَ أَبُو الزُّبَيْرِ قَالَ جَابِرُ بْنُ عَبْدِ اللَّهِ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ وَمَنِ انْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا ‏"

Narrated Jabir ibn Abdullah:

The Prophet (ﷺ) said: Cutting of hand is not to be inflicted on one who plunders, but he who plunders conspicuously does not belong to us.

Reported by Abu Dawud (No. 4391, 4393) and Ahmad (No. 14539).

Al-Azimabadi — Awn al-Ma'bud

( لَيْسَ عَلَى الْمُنْتَهِب ) : النَّهْب هُوَ الْأَخْذ عَلَى وَجْه الْعَلَانِيَة قَهْرًا ( قَطْع ) : وَالنَّهْب وَإِنْ كَانَ أَقْبَح مِنْ الْأَخْذ سِرًّا , لَكِنْ لَيْسَ عَلَيْهِ قَطْع لِعَدَمِ إِطْلَاق السَّرِقَة عَلَيْهِ ( وَمَنْ اِنْتَهَبَ نُهْبَة ) : بِضَمِّ النُّون الْمَال الَّذِي يُنْهَب وَيَجُوز أَنْ يَكُون بِالْفَتْحِ وَيُرَاد بِهَا الْمَصْدَر ( مَشْهُورَة ) : أَيْ ظَاهِرَة غَيْر مَخْفِيَّة صِفَة كَاشِفَة ( فَلَيْسَ مِنَّا ) : أَيْ مِنْ أَهْل طَرِيقَتنَا أَوْ مِنْ أَهْل مِلَّتنَا زَجْرًا.…

Jabir reported God’s Messenger as saying, "Cutting off the hand is not to be inflicted on one who plunders, but he who does so conspicuously does not belong to us.” Abu Dawud transmitted it.

وَعَنْ جَابِرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ وَمَنِ انْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا» . رَوَاهُ أَبُو دَاوُد
