حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الْخُزَاعِيُّ، حَدَّثَنَا جَرِيرُ بْنُ حَازِمٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُبَيْدٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَمَّارٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنِ الضَّبُعِ فَقَالَ ‏"‏

هُوَ صَيْدٌ وَيُجْعَلُ فِيهِ كَبْشٌ إِذَا صَادَهُ الْمُحْرِمُ ‏"

Narrated Jabir ibn Abdullah:

I asked the Messenger of Allah (ﷺ) about the hyena. He replied: It is game, and if one who is wearing ihram (pilgrim's robe) hunts it, he should give a sheep as atonement.

( فَقَالَ هُوَ صَيْد ) : قَالَ الْخَطَّابِيُّ : إِذَا كَانَ قَدْ جَعَلَهُ صَيْدًا وَرَأَى فِيهِ الْفِدَاء فَقَدْ أَبَاحَ أَكْله كَالضِّبَاءِ وَالْحُمُر الْوَحْشِيّ وَغَيْرهَا مِنْ أَنْوَاع صَيْد الْبَرّ , وَإِنَّمَا أَسْقَطَ الْفِدَاء فِي قَتْل مَا لَا يُؤْكَل فَقَالَ " خَمْس لَا جُنَاح عَلَى مَنْ قَتَلَهُنَّ فِي الْحِلّ وَالْحَرَم " الْحَدِيث ( وَيُجْعَل ) : بِصِيغَةِ الْمَجْهُول ( فِيهِ ) : أَيْ فِي الضَّبُع ( كَبْش ) : وَفِي بَعْض النُّسَخ كَبْشًا بِالنَّصْبِ , وَعَلَى هَذَا يَكُون يَجْعَل عَلَى الْبِنَاء لِلْمَعْلُومِ. وَفِيهِ دَلِيل عَلَى أَنَّ الْكَبْش مِثْل الضَّبُع , وَفِيهِ أَنَّ الْمُعْتَبَر فِي الْمِثْلِيَّة بِالتَّقْرِيبِ فِي الصُّورَة لَا بِالْقِيمَةِ , فَفِي الضَّبُع الْكَبْش س…

Ibn Abi ‘Ammār reported: I said to Jābir: "Are hyenas a type of game (animal)?" Jābir replied: ‘Yes.’ I asked: "Did the Messenger of Allah (may Allah's peace and blessings be upon him) say that?" He replied: 'Yes.'

الضَّبُعُ صَيْدٌ هِيَ قَالَ نَعَمْ ‏.‏ قَالَ قُلْتُ آكُلُهَا قَالَ نَعَمْ ‏.‏ قَالَ قُلْتُ لَهُ أَقَالَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم قَالَ نَعَمْ

"I asked Jabir bin Abdulla about hyenas, and he told me to eat them. I said: "Is it not game? He said: 'Yes' I said: 'Did you hear that from the Messenger of Allah?' He said: 'Yes.'"

فَأَمَرَنِي بِأَكْلِهَا ‏.‏ قُلْتُ أَصَيْدٌ هِيَ قَالَ نَعَمْ ‏.‏ قُلْتُ أَسَمِعْتَهُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ نَعَمْ ‏.‏

Yahya related to me from Malik from Abu'z-Zubayr that Umar ibn al-Khattab gave the judgement of a ram for a hyena, a female goat for a gazelle, a she-goat less than one year old for a rabbit, and a four month old kid for a jerboa.

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ أَبِي الزُّبَيْرِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَضَى فِي الضَّبُعِ بِكَبْشٍ وَفِي الْغَزَالِ بِعَنْزٍ وَفِي الأَرْنَبِ بِعَنَاقٍ وَفِي الْيَرْبُوعِ بِجَفْرَةٍ ‏.‏

Authentic Sunan Ibn Majah 3085

“The Messenger of Allah (ﷺ) stipulated (the penalty of) a man for a hyena killed by a man in Ihram, and he considered it as game.”

جَعَلَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ فِي الضَّبُعِ يُصِيبُهُ الْمُحْرِمُ كَبْشًا وَجَعَلَهُ مِنَ الصَّيْدِ ‏.‏

Authentic Sunan Ibn Majah 3236

“I asked Jabir bin ‘Abdullah about hyenas: ‘Are they game (that can be hunted)?’ He said: ‘Yes.’ I said: ‘Can I eat them?’ He said: ‘Yes.’ I said: ‘Is this something that you heard from the Messenger of Allah (ﷺ)?’ He said: ‘Yes.’”
