حَدَّثَنَا حَجَّاجُ بْنُ أَبِي يَعْقُوبَ، حَدَّثَنَا مُوسَى بْنُ دَاوُدَ، حَدَّثَنَا مُحَمَّدُ بْنُ مُسْلِمٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي الشَّعْثَاءِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏

كُلُّ قَسْمٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى مَا قُسِمَ لَهُ وَكُلُّ قَسْمٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قَسْمِ الإِسْلاَمِ ‏"

Narrated Abdullah ibn Abbas:

The Prophet (ﷺ) said: An estate which was divided in pre-Islamic period may follow the division in force then, but any estate in Islamic times must follow the division laid down by Islam.

Al-Azimabadi — Awn al-Ma'bud

( كُلّ قَسْم ) : مَصْدَر أُرِيدَ بِهِ الْمَال الْمَقْسُوم ( قُسِمَ ) : بِصِيغَةِ الْمَجْهُول ( فِي الْجَاهِلِيَّة فَهُوَ عَلَى قَسْم ) : بِصِيغَةِ الْمَجْهُول. قَالَ الْخَطَّابِيُّ : فِيهِ بَيَان أَنَّ أَحْكَام الْأَمْوَال وَالْأَسْبَاب وَالْأَنْكِحَة الَّتِي كَانَتْ فِي الْجَاهِلِيَّة مَاضِيَة عَلَى مَا وَقَعَ الْحُكْم مِنْهُمْ فِيهَا فِي أَيَّام الْجَاهِلِيَّة لَا يُرَدّ مِنْهَا شَيْء فِي الْإِسْلَام , وَأَنَّ مَا حَدَثَ مِنْ هَذِهِ الْأَحْكَام فِي الْإِسْلَام , فَإِنَّهُ يُسْتَأْنَف فِيهِ حُكْم الْإِسْلَام اِنْتَهَى. قَالَ الْمُنْذِرِيُّ وَأَخْرَجَهُ اِبْن مَاجَهْ.…

"‏ أَيُّمَا دَارٍ أَوْ أَرْضٍ قُسِمَتْ فِي الْجَاهِلِيَّةِ فَهِيَ عَلَى قَسْمِ الْجَاهِلِيَّةِ وَأَيُّمَا دَارٍ أَوْ أَرْضٍ أَدْرَكَهَا الإِسْلاَمُ وَلَمْ تُقْسَمْ فَهِيَ عَلَى قَسْمِ الإِسْلاَمِ ‏"

“Whatever division of inheritance was made during the Ignorance period, stands according to the division of the Ignorance period, and whatever division of inheritance was made during Islam, it stands according to the division of Islam.”

"‏ مَا كَانَ مِنْ مِيرَاثٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى قِسْمَةِ الْجَاهِلِيَّةِ وَمَا كَانَ مِنْ مِيرَاثٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قِسْمَةِ الإِسْلاَمِ ‏"
