حَدَّثَنَا هِشَامُ بْنُ عَبْدِ الْمَلِكِ الْيَزَنِيُّ، حَدَّثَنَا بَقِيَّةُ بْنُ الْوَلِيدِ، عَنْ سَعْدٍ الأَغْطَشِ، - وَهُوَ ابْنُ عَبْدِ اللَّهِ - عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَائِذٍ الأَزْدِيِّ، - قَالَ هِشَامٌ وَهُوَ ابْنُ قُرْطٍ أَمِيرُ حِمْصَ - عَنْ مُعَاذِ بْنِ جَبَلٍ، قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَمَّا يَحِلُّ لِلرَّجُلِ مِنَ امْرَأَتِهِ وَهِيَ حَائِضٌ قَالَ فَقَالَ ‏"‏

مَا فَوْقَ الإِزَارِ وَالتَّعَفُّفُ عَنْ ذَلِكَ أَفْضَلُ ‏"

Narrated Mu'adh ibn Jabal:

I asked the Messenger of Allah (ﷺ): What is lawful for a man to do with his wife when she is menstruating? He replied: What is above the waist-wrapper, but it is better to abstain from it, too.

Abu Dawud said: This (tradition) is not strong.

Al-Azimabadi — Awn al-Ma'bud

( الْيَزَنِيّ ) : بِفَتْحِ التَّحْتَانِيَّة وَالزَّاي بَطْن مِنْ حِمْيَر ( عَنْ سَعْد الْأَغْطَش ) : بِمُعْجَمَتَيْنِ بَيْنهمَا مُهْمَلَة كَأَعْمَش وَزْنًا وَمَعْنًى. قَالَ الْجَوْهَرِيّ : الْغَطَش فِي الْعَيْن : شِبْه الْعَمَش ( قَالَ هِشَام ) بْن عَبْد الْمَلِك شَيْخ أَبِي دَاوُدَ ( هُوَ ) : أَيْ عَائِذ وَالِد عَبْد الرَّحْمَن الْأَزْدِيِّ ( اِبْن قُرْط ) : بِضَمِّ الْقَاف وَسُكُون الرَّاء ( أَمِير حِمْص ) : بِكَسْرِ الْحَاء وَسُكُون الْمِيم : بَلَد مَعْرُوف بِالشَّامِ ( وَالتَّعَفُّف ) : أَيْ التَّكَفُّف وَالتَّجَنُّب ( عَنْ ذَلِكَ ) : أَيْ الِاسْتِمْتَاع مِنْ الْحَائِض بِمَا فَوْق الْإِزَار ( أَفْضَل ) : قَالَ الْعِرَاقِيّ : هَذَا يُقَوِّي مَا يُقَرَّر مِنْ ضَعْف الْحَدِيث فَإِنَّهُ خِلَ…

Mu'adh b. Jabal said that he asked God’s messenger what was lawful for him in his wife when she was menstruating, and he replied, “What is above the waist-wrapper, but to abstain from that is better.” Razin transmitted it and Muhyi as-Sunna said that its insad is not strong.

The Prophet (ﷺ) used to embrace me during my menses. He also used to put his head out of the mosque while he was in I`tikaf, and I would wash it during my menses.

Maimunah daughter of Al Harith said “When the Apostle of Allaah(ﷺ) intended to associate and lie with any of his wives who was menstruating, he ordered her to wrap up the lower garment(loin-cloth) and then he had association with her.

أَرَادَ أَنْ يُبَاشِرَ امْرَأَةً مِنْ نِسَائِهِ وَهِيَ حَائِضٌ أَمَرَهَا أَنْ تَتَّزِرَ ثُمَّ يُبَاشِرُهَا ‏.‏
