حَدَّثَنَا هَارُونُ بْنُ مُحَمَّدِ بْنِ بَكَّارٍ، حَدَّثَنَا مَرْوَانُ، - يَعْنِي ابْنَ مُحَمَّدٍ - حَدَّثَنَا الْهَيْثَمُ بْنُ حُمَيْدٍ، حَدَّثَنَا الْعَلاَءُ بْنُ الْحَارِثِ، عَنْ حَرَامِ بْنِ حَكِيمٍ، عَنْ عَمِّهِ، أَنَّهُ سَأَلَ رَسُولَ اللَّهِ صلى الله عليه وسلم مَا

يَحِلُّ لِي مِنَ امْرَأَتِي وَهِيَ حَائِضٌ قَالَ ‏"‏ لَكَ مَا فَوْقَ الإِزَارِ ‏"

Narrated Abdullah ibn Sa'd al-Ansari:

Abdullah asked the Messenger of Allah (ﷺ): What is lawful for me to do with my wife when she is menstruating? He replied: What is above the waist-wrapper is lawful for you.

The narrator also mentioned (the lawfulness of) eating with a woman in menstruation, and he transmitted the tradition in full.

Classical commentary

Al-Azimabadi — Awn al-Ma'bud

( مَا يَحِلّ ) : مِنْ الِاسْتِمْتَاع وَالْمُبَاشَرَة ( لَك ) : حَقّ الِاسْتِمْتَاع ( مَا فَوْق الْإِزَار ) : أَيْ مَا فَوْق السُّرَّة لِأَنَّ مَوْضِع الْإِزَار هُوَ السُّرَّة. وَفِيهِ دَلِيل عَلَى جَوَاز الِاسْتِمْتَاع بِمَا فَوْق السُّرَّة مِنْ الْحَائِض وَعَدَم جَوَازه بِمَا تَحْت السُّرَّة , لَكِنْ حَدِيث عِكْرِمَة عَنْ بَعْض أَزْوَاج النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ " أَنَّ النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ كَانَ إِذَا أَرَادَ مِنْ الْحَائِض شَيْئًا أَلْقَى عَلَى فَرْجهَا شَيْئًا " أَخْرَجَهُ الْمُؤَلِّف فِي بَاب الرَّجُل يُصِيب مِنْهَا دُون الْجِمَاع , وَيَدُلّ عَلَى جَوَاز الِاسْتِمْتَاع مِنْ غَيْر تَخْصِيص بِمَحَلٍّ دُون مَحَلّ مِنْ سَائِر الْبَدَن غَيْر الْفَرْج ,…

The Prophet (ﷺ) used to embrace me during my menses. He also used to put his head out of the mosque while he was in I`tikaf, and I would wash it during my menses.

يُبَاشِرُنِي وَأَنَا حَائِضٌ‏.‏ وَكَانَ يُخْرِجُ رَأْسَهُ مِنَ الْمَسْجِدِ وَهْوَ مُعْتَكِفٌ فَأَغْسِلُهُ وَأَنَا حَائِضٌ‏.‏

While I was laying with the Prophet (ﷺ) under a single woolen sheet, I got the menses. I slipped away and put on the clothes for menses. He said, "Have you got "Nifas" (menses)?" I replied, "Yes." He then called me and made me lie with him under the same sheet.

فَدَعَانِي فَاضْطَجَعْتُ مَعَهُ فِي الْخَمِيلَةِ‏.‏

Maimunah daughter of Al Harith said “When the Apostle of Allaah(ﷺ) intended to associate and lie with any of his wives who was menstruating, he ordered her to wrap up the lower garment(loin-cloth) and then he had association with her.

أَرَادَ أَنْ يُبَاشِرَ امْرَأَةً مِنْ نِسَائِهِ وَهِيَ حَائِضٌ أَمَرَهَا أَنْ تَتَّزِرَ ثُمَّ يُبَاشِرُهَا ‏.‏
