حَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ، وَهَارُونُ بْنُ عَبْدِ اللَّهِ، - الْمَعْنَى - قَالاَ حَدَّثَنَا ابْنُ أَبِي فُدَيْكٍ، عَنِ الضَّحَّاكِ، - يَعْنِي ابْنَ عُثْمَانَ - عَنْ سَالِمِ أَبِي النَّضْرِ، عَنْ بُسْرِ بْنِ سَعِيدٍ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ ‏"‏

عَرِّفْهَا سَنَةً فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ وَإِلاَّ فَاعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ كُلْهَا فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ ‏"

Narrated Zayd ibn Khalid al-Juhani:

The Messenger of Allah (ﷺ) was asked about a find. He said: Make it known for a year. If its seeker comes, deliver it to him, otherwise note its container and its string. Then use it; if its seeker comes, deliver it to him.

Al-Azimabadi — Awn al-Ma'bud

( بَاغِيهَا ) : أَيْ طَالِبهَا ( ثُمَّ كُلْهَا ) قَالَ الْخَطَّابِيُّ : وَهَذَا يُصَرِّح بِإِبَاحَتِهَا لَهُ بِشَرْطِ أَنْ يُؤَدِّي ثَمَنهَا إِذَا جَاءَ صَاحِبهَا , فَدَلَّ أَنَّهُ لَا وَجْه لِكَرَاهَةِ الِاسْتِمْتَاع بِهَا وَقَالَ مَالِك : إِذَا أَكَلَ الشَّاة الَّذِي وَجَدَهَا بِأَرْضِ الْفَلَاة ثُمَّ جَاءَ رَبّهَا لَمْ يَغْرَمهَا وَقَالَ لِأَنَّ النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ جَعَلَهَا لَهُ مِلْكًا بِقَوْلِهِ هِيَ لَك أَوْ لِأَخِيك , وَكَذَلِكَ قَالَ دَاوُدَ , وَالْحَدِيث حُجَّة عَلَيْهِمَا وَهُوَ قَوْله بَعْد إِبَاحَة الْأَكْل فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ. وَقَالَ الشَّافِعِيّ : يَغْرَمهَا كَمَا يَغْرَم اللُّقَطَة يَلْتَقِطهَا فِي الْمِصْر سَوَاء اِنْتَهَى كَلَا…

"Make a public announcement about it for one year, if it is claimed then give it to him. Otherwise remember its sack, string, and its count. Then use it, and if its owner comes, give it to him."

He said: “Announce it for a year, then if someone describes it with its features, return it to him. If no one claims it, then remember the features of its leather bag and strap, and consume it (use it). Then if its owner comes along, give it to him.”
