حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا أَيُّوبُ، عَنْ أَبِي قِلاَبَةَ، عَنْ عَمِّهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم

فَدَى رَجُلَيْنِ مِنَ الْمُسْلِمِينَ بِرَجُلٍ مِنَ الْمُشْرِكِينَ ‏.‏

‘Imrān ibn Husayn reported: The Prophet (may Allah's peace and blessings be upon him) obtained the freedom of two Muslim men in captivity in exchange for a man from the polytheists.

Explanation

In this Hadīth, ‘Imrān ibn Husayn (may Allah be pleased with him) says that the Prophet (may Allah's peace and blessings be upon him) gave the polytheists a man from them and took two Muslim men from them instead. The Muslim jurists say that if the Muslims take prisoners of war, the Imām has four choices regarding them. These choices should be based upon the ruler's keenness to realize the best interest of Muslims. They are: killing them, enslaving them, setting them free for nothing, or setting them free for money or in exchange for Muslims imprisoned by the disbelievers.

Explanation in Arabic

في هذا الحديث يخبر عمران بن حصين رضي الله عنهما أن النبي صلى الله عليه وسلم أعطى المشركين رجلًا منهم وأخذ مكانه رجلين من المسلمين.

وقد ذكر الفقهاء أن المسلمين إذا أسروا أحداً من أهل الحرب فإن الإمام يخير فيهم بين أربعة أمور، تخيير مصلحة واجتهاد في الأصلح لا تخيير شهوة: إما القتل، وإما استرقاقهم، وإما المنُّ عليهم بدون شيء، وإما الفداء بمال أو أسير مسلم بأن يُطلق الأسير الكافر مقابل إطلاق رجل مسلم مأسور عند الكفار.

  • جواز فداء أسرى المسلمين بأسرى المشركين.
  • جواز فداء الأسير المشرك بمال أو بمنفعة كما فعل النبي -صلى الله عليه وسلم- في أسارى بدر حيث أطلقهم على أن يعلموا أهل المدينة.
  • عناية الإسلام بالأسارى وحرصه على تخليصهم.
