Chapter: What Has Been Related About Using What Is Pawned

حَدَّثَنَا أَبُو كُرَيْبٍ، وَيُوسُفُ بْنُ عِيسَى، قَالاَ حَدَّثَنَا وَكِيعٌ، عَنْ زَكَرِيَّا، عَنْ عَامِرٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏

"‏ الظَّهْرُ يُرْكَبُ إِذَا كَانَ مَرْهُونًا وَلَبَنُ الدَّرِّ يُشْرَبُ إِذَا كَانَ مَرْهُونًا وَعَلَى الَّذِي يَرْكَبُ وَيَشْرَبُ نَفَقَتُهُ ‏"

Narrated Abu Hurairah:

That the Messenger of Allah (ﷺ): "A riding animal can be ridden while it is pawned, and a milking animal can be milked while it is pawned, and it is up to the one riding and drinking (the milk) to maintain it."

[Abu 'Eisa said:] This Hadith is Hasan Sahih.

We do now know of it being Marfu' except by the narration of 'Amir Ash-Sha'bi from Abu Hurairah. Others have reported this Hadith from Al-A'mash, from Abu Salih, from Abu Hurairah in Mawquf form.

This is acted upon according to some of the people of knowledge, and it is the view of Ahmad and Ishaq.

Some of the people of knowledge said that one may not benefit in any way from what is pawned.

Al-Mubarakfuri — Tuhfat al-Ahwadhi

قَوْلُهُ : ( الظَّهْرُ يُرْكَبُ ) بِصِيغَةِ الْمَجْهُولِ , وَكَذَلِكَ يُشْرَبُ وَهُوَ خَبَرٌ بِمَعْنَى الْأَمْرِ. وَالْمُرَادُ مِنْ الظَّهْرِ ظَهْرُ الدَّابَّةِ , وَقِيلَ الظَّهْرُ الْإِبِلُ الْقَوِيُّ يَسْتَوِي فِيهِ الْوَاحِدُ وَالْجَمْعُ ( وَلَبَنُ الدَّرِّ ) بِفَتْحِ الْمُهْمَلَةِ وَتَشْدِيدِ الرَّاءِ مَصْدَرٌ بِمَعْنَى الدَّارَّةِ أَيْ ذَاتِ الضَّرْعِ. وَقَوْلُهُ لَبَنُ الدَّرِّ مِنْ إِضَافَةِ الشَّيْءِ إِلَى نَفْسِهِ كَقَوْلِهِ تَعَالَى { وَحَبَّ الْحَصِيدِ } قَالَهُ الْحَافِظُ ( وَعَلَى الَّذِي يَرْكَبُ وَيَشْرَبُ نَفَقَتُهُ ) أَيْ كَائِنًا مَنْ كَانَ هَذَا ظَاهِرُ الْحَدِيثِ. وَفِيهِ حُجَّةٌ لِمَنْ قَالَ يَجُوزُ لِلْمُرْتَهِنِ الِانْتِفَاعُ بِالرَّهْنِ إِذَا قَامَ بِمَصْلَحَتِهِ وَلَ…

Allah's Messenger (ﷺ) said, "The mortgaged animal can be used for riding as long as it is fed and the milk of the milch animal can be drunk according to what one spend on it. The one who rides the animal or drinks its milk should provide the expenditures."

الرَّهْنُ يُرْكَبُ بِنَفَقَتِهِ إِذَا كَانَ مَرْهُونًا، وَلَبَنُ الدَّرِّ يُشْرَبُ بِنَفَقَتِهِ إِذَا كَانَ مَرْهُونًا، وَعَلَى الَّذِي يَرْكَبُ وَيَشْرَبُ النَّفَقَةُ ‏"

Abu Huraira reported God’s Messenger as saying, “An animal may be ridden for payment when it is in pledge and the milk of milch-camels may be drunk of payment when in pledge, payment being made by the one who rides and the one who drinks.” Bukhari transmitted it.
