حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا وَكِيعٌ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ مُحَمَّدِ بْنِ زِيَادٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ النَّبِيُّ صلى الله عليه وسلم ‏

"‏ مَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِالْخِيَارِ إِذَا حَلَبَهَا إِنْ شَاءَ رَدَّهَا وَرَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ ‏"

Narrated Abu Hurairah:

That the Prophet (ﷺ) said: "Whoever purchased an animal that has not been milked, then he the choice when he milks it, if he wishes he may return it, returning a Sa' of dried dates along with it."

[Abu 'Eisa said:] There are narration on this topic from Anas, and a man from the Companions of the Prophet (ﷺ).

Al-Mubarakfuri — Tuhfat al-Ahwadhi

قَوْلُهُ : ( فَهُوَ بِالْخِيَارِ إِذَا حَلَبَهَا ) وَفِي رِوَايَةٍ لِلشَّيْخَيْنِ : بَعْدَ أَنْ يَحْلِبَهَا. قَالَ الْحَافِظُ : ظَاهِرُ الْحَدِيثِ أَنَّ الْخِيَارَ لَا يَثْبُتُ إِلَّا بَعْدَ الْحَلْبِ , وَالْجُمْهُورُ عَلَى أَنَّهُ إِذَا عَلِمَ بِالتَّصْرِيَةِ ثَبَتَ لَهُ الْخِيَارُ وَلَوْ لَمْ يَحْلِبْ , لَكِنْ لَمَّا كَانَتْ التَّصْرِيَةُ لَا تُعْرَفُ غَالِبًا إِلَّا بَعْدَ الْحَلْبِ ذَكَرَ قَيْدًا فِي ثُبُوتِ الْخِيَارِ , فَلَوْ ظَهَرَتْ التَّصْرِيَةُ بِغَيْرِ الْحَلْبِ فَالْخِيَارُ ثَابِتٌ ( إِنْ شَاءَ رَدَّهَا وَرَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ ) أَيْ عِوَضًا عَنْ لَبَنِهَا لِأَنَّ بَعْضَ اللَّبَنِ حَدِيثٌ فِي مِلْكِ الْمُشْتَرِي , وَبَعْضَهُ كَانَ مَبِيعًا فَلِعَدَمِ تَمْيِيزِهِ اِمْتَ…

He who buys a goat with its udder tied up has the option to retain the goat if he so desires or return it within three days, and in case he returns it he should do so along with a sa' of dates.

مَنِ ابْتَاعَ شَاةً مُصَرَّاةً فَهُوَ فِيهَا بِالْخِيَارِ ثَلاَثَةَ أَيَّامٍ إِنْ شَاءَ أَمْسَكَهَا وَإِنْ شَاءَ رَدَّهَا وَرَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ ‏"

The Prophet (ﷺ) as saying: If anyone buys sheep whose udders have been tied up, he has option for three days: he may return it if he desires with a sa' of any grain, not (necessarily) wheat.

Abu Al- Qasim said: "Whoever buys a Musarrah, he has the choice (of annulling the deal) for three days. If the wishes ti keep it, he may keep it, and if he wishes to return it, he may return it, along with a Sa of daters, not wheat." (Sahih )

"‏ مَنِ ابْتَاعَ مُحَفَّلَةً أَوْ مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلاَثَةَ أَيَّامٍ إِنْ شَاءَ أَنْ يُمْسِكَهَا أَمْسَكَهَا وَإِنْ شَاءَ أَنْ يَرُدَّهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ لاَ سَمْرَاءَ ‏"

"O Allah, bless my nation in their early mornings.". It was narrated from Abu Hurairah that the Prophet (ﷺ) said: "Whoever buys a Musarrah, he has the choice (of annulling the deal) for three days. If he returns it, then he must also give a Sa' of dates, not Samra'." Meaning wheat.
